I just want it over with now , the lady from probation who as done the psr is saying unlikely going to prison her recommendations is community order are suspended sentence .

But why was it sent to crown court and not in magistrates

I totally get that we need to take it as a positive with the probation and psr but is it bad of me not to get my hopes up

He as a good pre sentence report

Gone and got help with his alcohol dependency on his own

Got good family support , a good character reference from work but had to leave due to suffering anxiety and panic attacks

He as as 6 chacter reference from family and friends plus is old boss

My oh is also doing a letter to court

His their anything else we can do for court

I get the prisons are full and it be highly unlikely he goes to prison we also have a good soclitor as well just freaking out big style .

Do I dare to believe its all going to come good

Thanks for listening xxxx

I feel you. The run up to sentencing is an anxious time.

But from the sounds of it he has positive support and has worked hard to improve himself. All of this will be taken into account by the judge.

Our case stayed at magistrates only because it fell within their sentencing powers. They did reserve the right to change it to Crown depending on the outcome of the PSR.

In some cases it can be better that it goes to Crown as judges have more experience than magistrates (who are volunteers).

I will keep you in my thoughts xx

Good luck. Please don't think that crown court always equals prison, that was my fear but in my person's situation it just meant that the suspended sentence was able to be longer (18 months opposed to 12 months). It all sounds as positive as it can do. I made sure to mentally prepare for the worst but always always hoped for the best. Best of luck x
