Hi

Does anyone know how long for a decision to be made about charging or not charging once a file has gone to the Crown Prosecution Service?

Hi Flower,

Unfortunately these cases have to go via a specialist part of the CPS and depending on your area the backlog can be ridiculous just like the police.

I think I have seen one case - JB72's husband who they were told in Oct last year they would get charge decision in weeks and I haven't seen an update but assume they still haven't had it.

I'd call the investigating officer and ask what the real timescale is for it not the one they like to give.

I don't know if it depends what part of the country you are in or not, but we waited 3 months from it being sent to cps to being charged.

Hi flower,

ttkit is right we were told several times it had gone to cps and would take approx 4 weeks, we heard back from the police before Christmas that the cps had more questions which we answered and then was told it would go to cps again on the 5th of dec with another 4 week wait, they finally came back with the charges 3 weeks ago, he now has his plea hearing on the 19th March, so basically first interview Oct 12 2018, released under investigation, second interview may 2019 told then it would be 4 weeks! 16 months on :(

Will just have to wait then I guess. He had to move out the day of the Knock in July 2019 and he doesn't live here now. We're barely in touch - I can't take in that the man I thought was wonderful could do this.

Our son's case took 15 months to get to court although he pleaded guilty at the first interview, although that is pretty quick from other posts. He was let down badly by his solicitor who failed to inform him of court dates and procedures anywhere near adequately. He was not even informed of his sentencing date at Crown Court! He was on the "warned list" which means you should be informed of your court date the day before by your solicitor, this is only normally used for sentencing. He was phoned by the court asking where he was! it was very stressful.
