Husbands charges have just come through the post, worse than I thought.

Any idea what happens now and what this will look like with him being charged at court?

The first step is always to enter a plea at the magistrates. Court date should be in the letter.

He should speak to the solicitor first, to see if he has any possible defences he can use.

Assuming he pleads guilty, probably a 2 year suspended sentence, or a 3 year community order. A lot depends on how good his solicitor is at mitigation.

edit. Forget to mention, that if you are in Scotland, there is another possibility, namely a community payback order, which could be 1 to 2 years.

Okay thank you. We have a two year old aswell, does this mean social services will come back now he is charged or wait until sentencing? As they closed the case last year and allowed him to be at home.

Sounds similar to my son yesterday he received a 2 year suspended 10 year on register amd a 1200 fine he can't do community service as he's physically disabled

min sure there lots of people that can help on here with children and the impact of that

Thank you for your responses. Do you know if they take into account severe mental health? And mitigating factors etc? So worried because he's already attempted suicide when the knock happened nearly two years ago and today has nearly tipped him over the edge.

They will take mitigating factors into account, as well as aggravating factors, good luck with everything

Yes they do my person has complex physical disabilities and is a wheel chair user amd had a breakdown as a teenager

that being said they knocked 3 months off a sentence for this

make sure when they ask for references for court you contact the GP he's been talking too etc x
