My son was arrested March 24. His bail kept being extended, twice through Magistrates Court. He has now been RUI. His solicitor has said Police have overwhelming evidence, so why has he not been charged ? This waiting is messing with my head, one day i'm fine , the next i'm down and crying (more days than not now). Has anyone else had this ? Thanks x
Yes, many of us have had this kind of thing happen, but it sounds to me that the police haven't received any charges yet from the CPS and until then, saying there is overwhelming evidence is just their subjective opinion, although the solicitor will have a good idea if he knows what they've found - but if the solicitor knows so should you..
Of course they may well be correct, and the comment was based on evidence that is a done deal or your person might have admitted to everything, but if the CPS decide that they won't get a conviction the result will be 'no further action'. The police are the starting point for each case with their investigation but they don't make ultimate decisions, that's the CPS.
Do you know if the investigation has gone to the CPS yet? If so things are nearer to a conclusion but you could still have some time to wait for charges, then a plea hearing (about a month to wait) and then there could be another wait if the case goes to crown court and even longer if there's a not guilty plea as that means a wait for a trial. Sorry to be gloomy as waiting is horrible, but things take a lot longer than we'd like.

Rainyday 52 thank you. I don't know if it has gone to the CPS, we only get told what my son decides to tell us.......and thats not a lot! X
Hiya, I wonder if you can contact the arresting officer directly and ask if there is a way to get an update?

Oh, that's good news! As long as has put it in writing to them, or spoken directly to them, aurhorising you, you can keep on at them for updates, which should help you feel a bit more on top of things.
