Has anyone ever been issued a RIPA section 49 I'm more interested in hearing from people whose son was under 18 at time of offence and still only 18 or slightly over after being arrested thanks
This is a demand to handover passwords or a pin number for a phone. Quite unusual, because the police usually try to break into a phone first and they can always ask the person for the information, if they do not succeed.
It would require a lot of extra paperwork to issue a RIPA notice, which is why the police normally avoid it. But if the person has genuinely forgotten their password or their pin and it goes to court, then the CPS would have to prove beyond reasonable doubt, that the person could not give police the details.
