OH was sentenced today. 14 months suspended for two years, SOR and SHPO for 10 years. What kind of restrictions will we have now he has been sentenced in terms of SHPO? Barrister tried to make the SHPO internet only restrictions but the judge was harsh and said contact restrictions also. We have a 3 year old.

Would social services do assessment to determine the risk level of OH and then go from there?

Is it up to social services if he is allowed to come with me and my daughter to say the farm, the park or anything like that?

Is there a chance after 5 years, that we can apply to the court to reduce the SHPO? If he is compliant with everything?

Sorry for the million questions, I thought after today I would feel some form of relief but I honestly don't. I thought the restrictions on SHPO would be internet only and 5 years. Was quite shocked as the judge disregarded OH's substantial amount of evidence on his mental health. It was honestly horrendous :(

Hi Fearful

I'm shocked at that outcome. I really thought the judge was more likely to follow the recommendation in the PSR so I wonder why he didn't.

I'm not sure about restrictions. We're still trying to figure it out ourselves. Did you get any media present? x

I'm devastated for my husband. All the hard work he has put in and the judge literally didn't care. The barrister informed us that the judge was harsh before we even went in to court, so I knew that it was going to go badly.

No media in court but I know they can still report on outcomes through court records so still on edge about that.

Just feeling sad now and dreading the new normal with all the restrictions especially now with the contact part. I'm glad it's over and he didn't go to prison but I just feel quite deflated in that all the effort was for nothing :( x

I'm so sorry to know the outcome is worse than you expected. I remember feeling very flat and sad after my son's sentencing.

The kind of restrictions you'll have will depend on the wording in the SHPO. For example my sons contact restriction states 'no unsupervised contact with under 18 years unless agreed with Social Services and the parents'. Other people have a 'no direct contact restriction'.

If your OH's restriction states that contact needs to be agreed with them then they'll probably want to undertake assessments and might decide to introduce contact gradually.

My understanding is that you can apply to the court for an amendment of the SHPO at any time but it needs the support of the police if done before 5 years.
