Is it correct that some people are ALSO charged on the same day as the knock & arrest?
My ex/children's father said the inital images he was arrested for were subsequently checked on the same day as the knock/arrest and deemed to be "actually not illegal" and that this is "WHY he wasn''t charged with anything" on the day of the knock/arrest. Then blased it off saying so now as part of their whole process they just need check his other devices, and saying this is the annoying part for him because there's a big backlog....
I later saw part of the police report that said those same initial images he'd said were "not illegal" were actually "known IIOC" .. so is there likely ANY truth in his claim of him saying they aren't illegal and that's WHY he wasn't charged on the knock day?!

Sorry, but I'd 100% believe the paperwork rather than what he is saying, which sounds like nonsense tbh.

My ex was arrested and charged on the same day for multiple offences. The officer leading his case said he "saw enough images on his phone on the day of arrest" to charge him. So yes, definitely happens.
Could I ask what sort of number of images he had? It sounds as though maybe the initial amount he has (in the 40s) isn't enough for a charge?
They can still bring charges even for a single image. But usually there is a proceess that involves checking and categorising each image to determine the category, A,B or C. That could involve checking them against the database of known images, because it speeds up the process and it could be done on the same day if that police force has the most up to date triage software.
Even then it still has to go to CPS for a charging decision, so getting all this done on the same day is unlikely, though not impossible.

If it was all cleared the same day as he claims would it be liklely that he still got bailed with strict conditions as he has done?

It's more normal not to be charged the same day because they want to investigate further, including foresnic examination of the devices and then if they think enough to charge send to cps for the decision. There are lots of grey areas and some images may be harder to age etc so unusual (from what I've seen on here) to be charged same day and more likely released on precharge bail with conditions to manage the risks until a charge can be brought. Which mostly takes ages due to backlog of forensic checks and number of these cases coming forward. It doesn't always mean, as he seems to be suggesting, that no offence has been committed.
Thank you - what I find hard to understand is if there are that number of IIOC confrimed (which I know from reading an extract from the police report ratger than from him, albeit it says they are on the oldest end age wise), could still be no charge/NFA ultimatly?
I'm not sure to be honest. Some do seem get NFA but I'm not sure what determines that. Every case is a little different so hard to know.
