Hi,

looking for some guidance on what happens in a magistrates court, does sentencing happen on the same day?

when do we find out what the consequences will look like?

thanks

If the plea hearing has happened, then in magistrates court, yes, the sentencing will take place there and then.

In my OH's case, following his guilty plea at the magistrates, they adjourned to consider next steps. After 5 or so minutes, they decided, given the severity of the charges, to pass sentencing to the Crown. This allowed time for the preparation of a pre-sentencing Probation report which was put together following a long interview with my OH to discuss the reasons why he offended and to assess the risk of reoffending. My OH found this process very postivie and reassuring and at the end of the interview, the probation officer said that they would propose a non-custodial sentence given all the history and mitigating factors. On the day in Crown Court, the judge accepted the advice from probation and, coupled with my character reference, handed him a community order. He also received a fine, SHPO, SOR restrictions but at least it was non-custodial. In fact, after reading the probation report, his Brief said she'd "eat her hat" if OH was sent down today.

Wishing you and your person, all the best x

Most likely Crown court unless very limited images and catogories, just pleas hearing at Magistrates then will be given a date for Crown in approx 6-8 weeks depending on location. Judge will give sentence at Crown, if he gives pleads guilty at Magistrates, will sign on SOR and await the outcome from judge at Crown Court (sentence depends on the judge on the day) paperwok will arrive in a few days confiming outcome of sentence if not custodial)

Probation report done for Crown if Magistrates request and Character references given approx 1 week before if there are any from close family etc, judge will look at all the information before deciding on sentence. Worst information read out in court and solicitor will put your case to the judge. Roughtly 15 minutes in Crown court but punctual timing. I would recommend doing Character references.
