To be honest it can all be down to the specific judge on the day... re his sentence. None of it really makes sense... Things that will go against him will be the amount of images.. How long as he been accessing, does he hold a job which carrys responsibility.. Have any images been re distributed... Things which will go in his favour... First offence / conviction, Genuine remorse, Has seeked help to deal with his offending, Letters of appreciation from friends, Partner standing by him to give support...
Finally CPS charging guidelines are very specific... A category A image passes the threshold for imprisonment. You only need one image... However the judge has discretion to suspend any sentence... The probation service will also submit a detailed report into your partners offending and attitude etc. They also can recommend different types of punishment... ie Community Service, Suspended sentence or prison.
My partner had 2A, 2B and 1C... He was given 12 months in prison suspended for 2 years...

My partner didn't have a second interview. Probably because he talked in his first interview. That is a very low amount of images Snowdrop, obviously one is too many. My partner received a 6 month prison sentence, for around 80 images in total (mostly in B and C). Orginally longer, but reduced on appeal. We were told that that was a low amount of images for these types of cases. They were all downloaded at the same time as a bulk file, so I personally didn't see the relevance on how many actual images there were.
We were expecting it to be suspended or a community order - indeed probation suggested that. Apparently the Judge felt a prison sentence was necessary - but after release they didn't feel he had any interest in children, and so were not recommending him to go on any courses. His assigned police officer after release noted that it was unusual to be sentenced to prison, and that they usually prefer a community based sentence. It's totally at the discretion of the judge whether or not to suspend a sentence. When I looked at news reports, most got a suspended sentence. Second offences or distribution were more likely to have a prison sentence.

I think the number of images does play a part but again inconsistencies. In our case it was 8 Cat C on phone. One had been opened only. After forensic examination with phone. However he accepted a caution with 2 years on sor as opposed to court and pleading not guilty. He just wanted it all to stop but this has had ramifications in that he is not allowed to see his children by his ex partner. He didn't get legal advice. I implore that anyone insists there loved one to get legal advice.
