Can someone please answer my query. So when a sentence is spent then a person does not need to tell a future employer however would it show on a dbs? I've looked online and a lot of spent offences are removed but I'm not so sure about a sex offence.

Also when it is spent but still on the sex register does that need to be declared to a future employer? I find it strange that the register is longer than the sentence. Thanks

A search online came up with this 'Criminal convictions become 'spent' after a certain amount of time. ... If you have spent convictions, they won't appear on a basic disclosure, but will show up on a standard or enhanced DBS check'.

with regards to the sex offenders register I'm not sure but would be surprised if it isn't disclosed tbh. Also it can take years for a sentence to be spent. I think 5 years from the end of a suspended sentence? Tho do not quote me in that.

Thanks for your reply. When I looked online it said certain offences dont become filtered (I'm assuming by filtered they mean dont show after being spent).

I read a basic dbs doesnt show registers but wondered if it still needed to be declared if someone is still on it

The conviction isn't spent until they are no longer on the SOR and any SHPO has also expired from what I have understood. This also applies to insurance.

Unlock.org is a good resource for post conviction questions. They also have a forum and helpline.

Hi it will always show up on a enhanced DBS. But once spent you don't have to tell an employer. Hugs xx

So my husband has a 3 year community order and has shpo that will end in 5 years and on register for 5 years. So community order will be spent after 4 years but the others wont be spent until 5 years so technically if asked after 4 years then he will still ha e to declare everything wouldnt he? Wouldnt be any point in not saying about community order because he will have to declare the shpo. So will now have to be an extra year
