Hi,

Wondering if anybody can help?

My husband was taken in for questioning Feb 20

He wasn't arrested and was released pending investigation.

The police have just called and said that they have finished with the investigation but they need him to go in next month so everything can be finalised.

They've not mentioned the words second interview or said they are charging him. They said he can drive in as he will be going home again.

Are they under legal obligation to tell you if you will be questioned again or not? Or if they are charging you?

Any idea what to expect from this? They were very vague.

You would know if he had been charged as they would have arrested him. You are still able to request information from the police though.

I would ask for legal representation to be present regardless. The final time my partner went into the police station while under investigation was when they explained what evidence they were going to send to CPS and the charges they were going to be out forward.

When charges were set my partner wasnt 'arrested'. He had two plain clothes officers deliver the letter with the charges. Tho this procedure differs I believe across regions. My partner was given a court hearing date and allowed to stay at home
