What will happen next..?

To cut my story as short as possible..

Our first knock was mid July 2020

My partners iPad, iPhone and laptop were taken, the phone and iPad returned a couple of days later and the laptop kept.



He was invited in by appointment mid September to talk to the main police officer on the case. He was told they’d found over 100 iioc (around 160 in cat C and 1 in B). They interviewed him and were going to send the case to the CPS.



My partners explanation of it all is that whilst downloading legal porn from file sharing sites, iioc have sometimes been included in the files (without him knowing what would be in them before downloading) and has just deleted them once he’d realised what they were.



What I’m wondering is what is next, it’s been almost 2 months since he went to his interview at the police station - Would communication from the CPS be taking longer due to covid? He’s never actually been arrested, does an arrest come after a decision from the CPS? And hes not been charged - does that too come from the CPS too? What is the likelihood of a caution or NFA response?



I feel we are coping ok with the situation under the circumstances (I guess the majority of the time we are trying to put it to the back of our minds), but when I start thinking about it all it really makes me feel stressed that I have no idea what to expect for the next part?

Hi he won't have been charged yet as they are investigating. It can take up to two years for hard drives to be examined. You just have to wait for them to complete their investigation (hell) then he will be reinterviewed and the case will go from there.



So sorry you are having to go through this.

Invited by appointment? That's the first time I've ever heard of that but then again I'm fairly new to this...

So he got the knock and they invited him to explain why he ahd the images without arresting him? Did he have a solicitor present?

Usually they take the devices away and examine them but it can take a while depending on where you are in the country... Some I have read take a few weeks, some I have read have taken years...

Then this gets packaged and sent to the CPS who decide what to do...

Yeah so basically on the day of the knock they said if they found anything on the devices he would be invited in by appointment to discuss it. I found it a bit odd they didn’t arrest him as that seems to be what happens - maybe it’s down to what area you’re in?



They then called him mid sept and invited him in due the the images that were found on the laptop. He chose not to have a solicitor. He just told them what he’d told me that the iioc had occurred on downloading legal porn and they seemed satisfied with his explanation. They said if they found anything more he’d have to come back for a second interview (we’ve heard nothing so assume it’s gone to the CPS now as they said that was what would happen). Obviously if things develop any further he will need a solicitor but he said he just wanted to cooperate as best he could at the time



I didn’t know if he’d be arrested once the CPS have looked at it - or maybe they just missed that stage with us. I guess then we are just waiting on the CPS. The thought of us going to court makes me feel sick - i just find it so awful not knowing

They would have known there was something on the devices or they wouldn't have been taken. He wouldn't have been charged at the first interview. I would say never ever speak to them without a solicitor. He'll be invited back to be charged after they have found what they are looking for.

I hope you're fairing up a little better now ? Has there been an update at all? Yours is similar to my case in the image catagory but my husband openly admitted and gave reasons (not excuses) as to why and fully admitted his guilt and that it was wrong (without a solicitor present) ...

a bit confused with this we had the knock and my son was charged straight away, i think it depends on what area you are in, the police now what has been viewed so should charge straight away x
