Heya Concerned,

Yes I believe that if you share it's classified as making. It sounds like your Ex is still in denial about the full extent of his crimes.

How are you holding up?

As Lee said if a file is saved in any way it is making (the term is strange but essentially means they made a copy). Sharing is distribution, and production is raw material (e.g took the image or film themselves). I use Kik and it won't automatically save images but there is setting vids to be autosaved if selected in the settings.

My partner didn't use Kik but he saved images to catfish but has admitted to saving iioc to trade with other offenders (sickening I know) so that he could build up a collection for his Catfish activities. He would pretend to be a young person to chat to adults...

My partner had all categories and sentenced for making (saving files) and distribution (sharing the content). Distribution has higher max sentence to making only. And production is ofc the worst of all three types.

I recommend your ex seek help to understand his offending and work on prevention from doing it again.

Also the law isn't forgiving if someone sees iioc and 'ignores' it e.g. not reporting and deleting. Deleted files can also be picked up by police.
