I dont know if anyone knows about this but i have received a letter from dbs saying that they want to bar my son from working with children and vulnerable adults as he as been convicted of communication offence, Has anyone had any luck with appealing this.

Sorry to hear this. I think it's quite usual for a person to be barred from working with children and vulnerable adults following a conviction of this nature. I'm not sure about appeals, sorry. Did they give a time limit or is it indefinite? You can ask for this to be reviewed after conviction is spent, time on sor is complete etc.

I am not sure how DBS have authority. I thought they are only in place to do background checks on behalf of others. I assume the SOR and SHPO has the restrictions in place to state cannot work with children. Unfortunately now that he has a conviction it will be brought in all background checks and any employer looking for staff to work with children (and I guess vulnerable people) cannot hire as they may be liable.

They do run background checks but the DBS have the ability to bar individuals from working with children and/or adults.
They receive information from police/LADO and make the final decision on whether they are barred.

I believe certain offences automatically bar someone from working in a role that requires the most advanced DBS check. There is no way to appeal that unless you can get the conviction overturned.
