Can a lawyer argue that a child on an over 18 app shouldn't be on there?!

Normally not. The law is there to protect the victim (under 18).

Thank u for ur reply. So it looks like it will be court no matter what then. (1 chat on app was told she was 12 but reply with if I was 12 I would date u.... chat then ended)

Depends on the offences, whether it will go to court or sorted outside court (caution/NFA). Also, the number of offences.

I think it's unlikely or was unlikely here in Scotland. My son is in prison for communication offence. One of the other prisoners tried to argue that and failed. He met someone on an over 18 dating thing. They met and had sex. Some time later the whole thing came to light and the man was sent to prison for five years. He went down the legal route of trying to have the site held responsible for allowing the underage person to come on their site and pretend to be 18. He had also put up a defence that the person had said they were 18 on the site but that failed to. Sadly, nothing happens to people who pretend to be older than they are on those sights. More sadly, nobody is holding those sites to account for allowing teenagers to be on there in the first place x

The asking for a photo is what is likely going to raise the most concern. It does for me. Not sure of the wording but could be deemed as some sort of inciting?

I do see why some might want to use the age of app use as a defence. My partner assumed that 9/10 people he was chatting to were lying about their age. He did, he would catfish and pretend to be young to get attention from anyone. Regardless since you can never be sure unless you know the person on the other side of the screen it has to be super precautionary.
