So we've been to magistrates court today. They've told him it's looking like it'll be a mid level community order. Does anyone know what that will entail? He's got to sign the SOR tomorrow but no idea for how long and he's got a phone call with a PO in three weeks then we are back to magistrates court not crown court in four weeks for sentencing. Has anyone else been sentenced at magistrates not at crown court? I thought it would be crown next?

It can be done at magistrates if the max sentence they can issue is I think less than a year. So it can happen. I suspect they will need to inform the police later how long they will be on the register but still need to sign up tomorrow.

The solicitor should be able to say what the max possiblity for a sentence. It will still be hard to say if suspended or custodial because it still depends on the judge on the day, regardless of magistrates or crown. I recommend prepare for the worst but hope for the best. But the solicitor will explain if custodial is even possible. Hard to say without the details of the charges.

Hi whyus

i just thought I'd reply to you as I'm in the same boat. My partner went to magistrates court in March and is due back there in early May. He was in possession of iioc too.

i fully expected us to have to go to crown court. I was on the phone to the helpline the other day and the lady said they obviously feel they can deal with it at magistrates and whilst most go to crown court the odd few stay in magistrates

my partner's solicitor also thinks he will get a community order. He signed on the SOR the following day
