Hi, a while back someone put on here an employment agency that where very good, I've looked back but I cant find the thread, hope everyone is doing OK today,

Hi Chelsea.

My partner for a job after his sentence. He hasn't needed to disclose. It is possible but more less likely with larger companies.

Did it take him long to get employment

He got two year suspended sentence and 200 hours community service for possession and distribution of iioc of all all categories. Tbh it was a surprise he got suspended, could have gone the other way tbh due to the number of images in each category.



He had a job already during the court case, thankfully his contract didn't say he had to disclose convictions. As soon as the sentencing was over he applied for jobs. There was a recruiter that contacted him over LinkedIn I think (he was looking to go back into the 'professional' sector).



He didn't tell the recruiter because it wasn't asked. He was lucky that he did have three interviews within 3 months of the sentence. He was asked in a second interview about convictions and he had to tell them (face to face....I don't think that is fair) and the person had to politely decline.



He then was offered jobs at two places and went for one that offered more Money and better vibe. They have never asked for conviction info. This is a small company tho, and is probably the only way to get a job with a conviction (unless it is a company or organisation that make an effort to employ criminals- but sex offences are one of the harder ones for employers to agree to).



He is very lucky to get a new job within 6 months of his sentence- the job market is tough for most people and convictions ofc make it so much harder.



I dread to think what would happen if they ever ask for conviction history. I don't know the legal rights but I would assume his work would oust him. His suspended sentence has just finished, so he has another 6 years where he has to disclose if asked. After that it would be 'spent'.



I'm praying that he will be able to keep his job otherwise we are going to be in a lot of financial trouble.



My partner's example is ofc not the standard as such. But somewhere on the forum someone mentioned that they used a recruitment agency that helped. There is support there, and if it is struggle there is support for retraining and getting GCSEs and maybe A levels (not sure).

I think it is something like the rehabilitation act that states that after 6 years after a sentence is over (in my partner's case he was sentenced for two years) then offenders do not need to disclose their conviction. The conviction would be known as being 'spent'. And I believe should not be brought up in background checks.

So overall my partner has to disclose where required for 8 years. - however his SHPO and SOR is for 10 years....I think he might have to disclose that even after the sentence is spent. I have only just realised that might be the case ..

Hi Chelsea 1/ Majestictopaz

When some one is convicted of an offence by the court there conviction is deemed unspent, this means that it will show on a basic DBS check and if they are asked by an employer if they have any unspent convictions under the rehabilitation of offenders act (ROA) they have to disclose, they have to do this with insurance be it car and house and also Mortgage applications if asked.

The ROA is designed that after a set period depending on the sentence imposed then after the full sentence is completed and then an extra period of time (again depending on the sentence received) the conviction will become spent and does not have to be disclosed when asked and will not show on a basic DBS check (Any sentence of more than 4yrs in custody will never become spent)

It is important to note that if applying for a job that is exempt from the ROA and if a standard or enhanced DBS check is done then the offence of this nature will always show on these checks, this types of jobs are limited.

If the person convicted also has a SHPO then while this is active it will stop the conviction from becoming spent and so would cause the conviction to show on a basic DBS. The time period of a SHPO starts from the date it is given by the court

It is also important to note that the SOR has no impact on when a conviction is spent or unspent this document is a notification tool only, it is important to note that the period on the register starts from the date that you first notify the police of your details.
