So today I have been told that even when my husband is releases he won't be coming home to us. He'll go to an approved address.

Is this really true, he's been living at home with us all and the kids right up until prison and ss have closed case.

Any one convictied of a sexual offence is normally released into approved premises, it has nothing to do with a persons SHPO or being on the register, it lets the person reintegrate into society and gives the offender manager/ probation officer get to know the person they will be monitoring while on licience, time is approved premises is not long especially if they have a place to move onto that probation have given the ok to

Again being on the register or having a SHPO has no bearing on being placed in approved premises it is dependent on the time served and the nature of the offence when some one is released and at the decision of the offender manager and MAPPA, while in approved premises probation will look at the housing situation and make a decision as and were a person can live as i mentioned in my first post, this decission has to be proportionate to the nature of the offence and backed up with current risk assessments, not reports that were undertaken when sentenced.

As i have mentioned in other posts the law around SOPO/SHPO is clear the courts ruled in 2011 that a SOPO/SHPO should not duplicate other regimes designed to offer public protection, and for a SOPO/SHPO to have any mention of no contact with someone under 18 there must be identifiable risk of a contact offence occurring befor this kind of prohibition can be made,(via up to date risk assessments) it cant be added "just in case something was to occur" if the person you know has this kind of issues in there SOPO/SHPO then it is not Smith and Pearson compliant and should be taken back to court,as it could be argued in a court of law that he document is invalid in the way it is writen as it goes against current precedence.

My FM is a year into his long sentence - I fear for his release. He lived with us but due to the circumstances of his crime he cannot return - so he will be homeless. He had the whole lot of 'orders' placed on him.

i pass the beggars on the streets and I cry inside wondering if this will happen to him one day. It's another set of traumas to face.

I understand this is a stressful time, but he will not be homeless. There are processes in place, while he is under licience upon his release his probation officer and MAPPA have a duty of care to him to ensure he is safe, this is one of the many reason people that have been sent to prison for a period of time and depending on the offence will be sent to approved premises.

Depending on the prison he is in (this system is not perfect by any means and covid has not helpped) and the offender manager he has will depend on when the process starts. Prior ot release the resettlement department in the prison will see him, they will have spoken to his probation officer so will have an idea of what is going on. Depending on his location they willl start to give information on housing and if required start to make emergency application to the local authorites for the area being released back into. Once released and in the approved premises this process continues and they will get assistance from the workers at the approved premises on howto sort our housing. Approved premises may not be the best solution but it does act as a safety net that gives people released from prison that extra time to sort the like of housing and other issues out.
