Hi there

I have a question and wonder if anyone can help. When an offender is charged they are sent a charge sheet with the list of charges and then they go to magistrates court to put in their plea. This commonly then gets passed on to crown court and then sentencing or trial is completed. My question is what they are charged with on the charge sheet is what they are sentenced for isn't it? That's is what they have pleaded guilty to and are charged with? Lots of other things were said in court by the prosecution, accusations and other things and I'm confused as to if they were charges or not.

In my friend's case,he pleaded not guilty (because he is not guilty) and they materially changed the charges at crown court !

Hi Lee

basically when my husband was first arrested it was for a conversation with an undercover police officer, it was very disturbing and implied he'd committed a contact offence.
When questioned about it he said he could not remember having the conversation at all.
They told him they were taking his devices and asked him if they were likely to find anything and he said yes they would probably find images which had been deleted, which they did.
When the investigation was complete he was charged with IIOCs and a conversation, but not the one he was first arrested for (it was a conversation where he encouraged the person to play porn when there was a child in the room) At sentencing the prosecution still brought the first conversation he was arrested for up in court, and it was like they were implying he had committed it, but it wasn't on the charge sheet when my husband put his plea in so it got us very confused indeed.

Thank you Lee that does make sense. My Husbands solicitor was terrible in court he didn't give a care. The worst part about it all is my brother who has a vendetta against us heard it all in court, and has presumed they were actual charges. Spreading it round on social media. I have sent him over a copy of the charge sheet, but he's still at it. We're just trying to move on now and rebuild our lives.

Hi Lee,

How do we get transcripts of what's happened? Can I get a transcript of the first police interview after the first arrest and then 2nd interview which will happen in hopefully next 6-8 weeks? Or is it just the court sessions?

Are the police interview worth getting? I assume it's easier to find out what questions are being asked as I'm just told he can't remember anything when I ask. I just want to know what we are dealing with so we can prepare ourselves psychologically if that's possible. I really appreciate your feedback so a big thank you
