Extreme pornography/sex offenders register

Good evening,

I'm curious.

My partner is up against about 200 extreme porn images. They're all animals. Nothing else.

He works in construction and him and his work friends were finding these videos and sending to each other, but that's neither here nor there.



Anyway as its a first offence and it's animals, I can't work out if he would be on the sex offenders register. His solicitor said it depends on the sentencing. If he gets anything under 2 years he won't be on it. Is this correct?



Can someone advise please!

The problem with extreme porn is that when those clever politicians made it illegal to possess same,they hid it in an immigration act and they did not block sites containing it.This means that if anyone views these sites,their computer will download and store images in the "internet cache" and unless they are very lucky,if they are discovered,then a crime will have been commited unless the services of a good computer forensics person is obtained.The onlyhope is that the images were deleted,as their is no offence of "making".My advice is to get a good expert,especially one who uses only the police's SFR.

Everyone has to remember,that every web page you view will have it's images stored on your computer.

Hi BrokenDreams,

Sorry to find yourself here. Please keep us posted on any information you find relating to this as my partner has also got 3 (6 due to being copied across via Cloud) he received in one of those stupid Whatsapp groups. I think one emulated having sex with an animal and 2 are classed as extreme pornography but again nothing iioc. It's worrying that he could effectively end up on sor for what some men find amusing!

I've just had a quick look online and it relates to children and adults in sexual offences when it comes to SOR so I would imagine not? Has your partner been charged or is it still with the CPS? xx

Baffled B: Did he request the images or were they sent unsolicited ? Did he delete them ?

If they were deleted,then the prosecution will have a hard time proving possession,and there is no offence of "making" extreme porn images.Take legal advice from a good solicitor.

sorry you find yourself here,

if the offence that a person is charged with is found in schedule 3 of the sex offences act 2003 then if they are found guilty they will be on the sex offenders register and time on the register as lee stated is based on the sentence received

extream porn can be delt with under section 63 of the crimnal justice and immigration act 2008 posession of extream images and this is found on schedule 3 so would cause a person to be on the register if charged under this act

as said above if the offence that they are charged with is not found in schedule 3 then they won't be on the register

I've just had a further look online and can't find any media articles which are solely for animal images. Seemingly there are only cases which involve animals and children. I shall continue looking x

I have just had a quick look at the sexual offences act 2003 and it does state that in respect of extreme pornography you will go on the SOR if the offender was 18 years or older and is sentenced in respect of the offence to impisonment to a term of at least 2 years.

Yes.

It's just animals. No IIOC.

He's plead guilty to it. As he did it. He didn't think he had any other option than to plead guilty and also the earlier you plead guilty you get a discount for sentencing apparently?

For him it's just the scare of being on SOR because of our children. Even though none of his offences relate to children, we don't want the social services backlash etc.

I've searched online extensively too and have seemed to only of found news articles relating to extreme AND IIOC. So don't have much to go by in terms of whether he is looking at a custodial.



It was his solicitor who said she doesn't think he would be on the SOR. But that doesn't appear to be the case unfortunately. What will be will be, we're just trying to prepare for the worst and pray for the best.

I think what your solicitor said is correct.

I have had a quick look at the sexual offences act 2003 and it does state that in respect of extreme pornography the offender will go on the SOR if the offender was 18 years or older and is sentenced in respect of the offence to imprisonment to a term of at least 2 years.

This is stated under 35A of Schedule 3 of the Sexual Offences for the purpose of Part 2. (Part 2 being whether someone goes on the SOR)

I hope this all makes sense, but you could double check it with your solcitor of LFF maybe.

If he pleaded guilty then I guess it'll be down to the CPS to decide if it's in the public interest or not to push forward with a case. Best case he could get a caution but again as we have no real life examples of this kind of case it's hard to say. My personal opinion is I can't see a severe punishment for it particularly if it's a part of a chat which is for "banter". If it was a group where it was clearly revolving around sexual gratification then it might be different but that's someone talking with common sense and reasoning. Keep us updated and I hope everything goes well for you xx

I've read conflicting information as well online regarding whether you're on the SOR. And as said previously I can't find any news articles of people that have just had extreme alone.

I know it's a crime (although I'm sure it didn't become a crime until 2000 and something) but the justice system seem to look at things very black and white.

He's got no previous for anything.

It all depends on the judge on the day I suppose. We're all just hoping that he doesn't get on the SOR or a custodial for it. ????
