Asked before for advice but I think has got lost in a thread. Are conditions of a SHPO set at the time of sentencing in court by the judge?

This looks to be the case acc to Google.

Just to clarify a SHPO starts from the day it is issued by the court, it is the SOR that does not start until the first time you make your first notification to the police either after your release from prison if given a custodial sentence or within three days if given a community sentence.

So if you sign the SOR pre sentence (after plea) and are given a custodial will it the time frame start again after release or just continue from the date of first signing? I've searched and searched for this answer.

Hi there!

From our experience my husband had to sign the register pre-sentencing and then when he was released he had to sign it again within three days of his release, but it is counted from the 1st signing. As for his SHPO that started immediately after sentencing, but he had no idea of the conditions until the day of his release, and was given a written copy.

I find it all so confusing as I've read you can't have a shpo without signing the sor (sure it was that way round) but the shpo in our case will last longer than the sor. As per always it's a minefield!

Whatever. Sometimes I need to stop thinking so much!

Hi Sarah just treat both as two sperate things

a person is placed on the SOR if convicted of a sex offence the SOR is a notification tool only.

a SHPO is a court order, and can be issued by the court if a person is found guilty of an offence under schedule 3 or 5 of the SOA 2003, a shpo is not an automatic thing the cps have to make an application to the courts and be able to prove why one needs to be applied

you can be on the SOR without a SHPO
