Morning, has anyone had to get legal advice regarding assessments whilst their husbands are in prison.

I know legal aid has been stopped for a lot of prison law areas and paying again will wipe up out but my husband finally got his oasys/ sentance report given to him. He was sentance for a communication offence with a decoy, no meeting.

Saying he had images (none ever sent,received or found on his phone). Said theres potential for him to attack babies (never had any contact offenses) That he has never been able to see his child (he had unlimited supervised access before sentancing) and the woman said she's surprised he's still married as if her husband did what he did she would feel she hadn't met his needs. Alongside a lot of other personal comments and inaccuracies. It seems they've read what's happened and added loads of extras which is really dangerous. Can't see any other way but to get legal help now, the system is scary!

Sorry for rambling I'm just so angry, hes never denied anything, got so much help before sebtancing and always been honest but it seems nothing is helping. He was doing so well in prison but now deflated again

Lee, His solicitor is pretty useless, did a visit after sentancing then everything signed off. Still not got devices back and they've said they don't have anything to do with that but will have a look at some other legal advise

Thanks feelsick, didn't realise it would have such an impact, so will definitely get him to sort it. we have a child and want contact on his release and some of the statements are horrendous. Thought we were getting somewhere but always seem to hit a wall, even when being open and honest throughout

Oh and Lee yes that's the report.

The pre-sentancing report from probation was actually really factual and ok. It's just this from the prison (omu) who have added bits that's hes never been charged with or any evidence of.

Fully agree with risk assessments but only when dealing with facts

I would definitely get it ironed out now if you are wanting contact.

Also be careful around release with license conditions. My partner went to prison for a violent offence, and his PO was awful. He made it impossible for him to see his own kids, based on opinion. Even though the offence was nothing to do with children he was deemed high risk around them. The only thing about challenging license conditions is the time it takes and money.. but hopefully if yours straightens this report he might be OK.. and hopefully he gets on with his PO because they can make life extremely hard xx

I agree that the factual aspects (like not have acces to kids) should be rectified. Unlikely going to have the option aspects changed tho. However the report should be updated as the sentence goes on. It is meant to be a record of risk of reoffending and so risk hopefully will go down. My partner was online offending only and had suspended sentence of two years. The risks went from high to medium, they are reluctant to go to low.

My partner's second follow up report was pants mostly due to covid restrictions and so wasnt a good representation. E.g. claiming he still used Kik even tho he stopped using it post sentence.

I believe cafcas had access to the report and they based alot of their opinion on that report, and it was written as if my partner had not done any rehabilitation. Even tho he went through LFF and their course before his sentence.

I would hope the PO who wrote it would be ok to correct aspects where possible without legal involved. But if they refuse I hope a solicitor could help. The unlock site might be able to advise

Many thanks everyone, she said she'll look into it when my husband raised his concerns so she may do the right think and put the facts in.

I will be raising a complaint as she has said some terrible things about myself and crossed so many lines that a professional really shouldn't do. Makes me question why people work in areas like this when they have such horrible opinions of the people they work with

I have not seen the report bit my partner did tell me the police stated they thought I was immature and child like because they came to my flat and saw my collectables. I never met them! I really wish they didn't comment on people they haven't met.
