I don't know about a data request but when you get charges the evidence will be sent to the solicitor and they request the interview tapes from the police.

Hi Daffodil

Your post has had me think back to when the young person in our family was interviewed by the police, which is well over a year ago now. I attended the interview as our family member was under 18 years as a Appropriate Adult. I recall them passing paperwork over to us after the interview (as our solicitor was remote because of COVID restrictions) and I am pretty sure it included instructions on how we could get copies of the interview tapes. Did you son get any paperwork given to him when he was interviewed? If so maybe worth having a look at now ....

From your post I am assuming he did not have an Appropriate Adult in the interview with him. If this is the case, I am very shocked that your son didn't have an appropriate adult in the interview (yourself being the obvious choice) as in previous posts you have said about your son's Autism. He may be over 18 years of age but if he is vulnerable he has a right to have an Appropriate Adult present as well as the solicitor.

Just a thought that the helpline may be able to give you advise on obtaining interview tapes/scripts but also maybe worth speaking with Unlock or NACRO maybe for their knowledge on this?

Hi Daffodil - I completely understand when you say 'I didn't know then what I know now..' I found it hard at the time that we were advised to give a 'no comment' interview. In my naviety I felt if the police were told the whole story they would understand but in hindsight giving a 'no comment' interview in our situation was the right thing to do. It took a while for the penny to drop for me that the police were only interested in getting a conviction and nothing else mattered.

Just found this link which will be of interest to you

You need to look at section 3.21 (conclusion of interview) which states under PACE rules what should happen after interview with the police. It appears you should have been given paperwork on how you can access a copy of interview.
