Hi,

my son was the same was under 18at the time of offence but 19 when we got the knock so yes he was treated as adult .
very little help for him/ us

Hello Polly Pocket

As a family we became aware of the proposed Youth Court and Sentencing Bill which had its first reading in Parliament in Feb 21. The bill was proposing that children who commit crimes before they are 18 are dealt with in Youth Courts and receive a youth sentence even if they are over 18 by the time they reach court. We were very saddened when the bill did not progress any further in the last parliamentary session, around May 21. We did contact our local MP about this and he did say that it will be starting the process again to go parliament sometime in the future. sadly, to date it appears this process has not started again.

The MP who bought the bill into parliament is Rob Butler and you can find information on this bill if you google his name and also the 'Youth Court and Sentencing Bill'

It does mean eventually this law is very likely to come into effect, we just don't know when. You could approach your local MP and ask if he knows when this proposed bill will get it's first hearing in parliament again.

You may find this factsheet from the charity 'Just for Kids Law' helpful/informative too

This charity has a lot of useful information on their website and can offer advise/support to young people up to the age of 25 years. If you live in London there is also the possibility they can represent the young person in court .

I am so sorry that all of you find yourself in this situation. It feels grossly unfair that once you turn 18, in the eyes of the law you are treated as an adult straight away.

I hope that the proposed bill starts again in the House of Commons for the Youth Court and Sentencing bill. As every day goes by I think of all the young people who fall foul of this gap in the law, it is so unfair.

I am in a similar position. We got the knock may 2022 when my son was 17, he is now 18 and cps have all information to decide whether to charge (which they will).my son was 15-16 when he downloaded these images cat A,B and C.The stress of this has almost killed me.we are petrified of it being in the local media.
