Please help. My OH was arrested, charged and held on remand. Three weeks later he was sentenced, with a suspended sentence so was released. He was on remand as he did not ask for bail. The police still have our devices even though the magistarte said to return them. The police have refused as they have only had them for three weeks. When he was sentenced the number of images was vastly different to what he got originally charged for, but he refuses to dispute anything as he does not want any attention. He is very depressed and suicidal and will not even speak to the solicitor as he says the police should know. But if he has been charged can they then arrest him again if they find more images? I am not saying they will but this is keeping me up at night. My OH says there are no more but he himself was surprised by the number quoted in the court. Bascially the number is over 7 times what he was originally told. Either my OH is not telling me the truth or the number of images are incorrect. If incorrect what stops the police saying there are more when there is not. How can we prove anything when the police have all the decvices. My OH does not seem to have any paperwork regarding his original charge nor what was brought up in court. Can anyone advise what I can do? This is sscary as i feel my OH is just accepting everything thrown at him. All the stories i have read the sentencing is months or years later even with a guilty plea. Ours were 3 weeks so all over very quickly. Thanks

I just wanted to bump this up the list for you as i noticed you hadnt had a response. Posts can get a little lost sometimes if there are a lot of posts.

Sorry I dont really have any advice for you. Did you person admit to the offences at first interview if they were charged straight away. Did they have a solicitor present? Also, did they not see the evidence between plea hearing and sentencing?

The time line does seem strange. It normally takes many months for phones to be examined, evidence sent to XPS and charges brought, but I'm not sure how or whether being held in remand would make any difference to these timelines.

I hope someone can offer some more information or advice.

Thank you for the advice. I have told my OH to speak to his solictor, but he seems reluctant to sort anything out. It does seem so strange our timeline is so quick compared to other cases. Like I said the magistrate told the prosecutor to return devices. I will tell my OH to speak to his solicitor and if not then I will try. The last time i tried to speak to the solicitor I was told I was not his client. He put in a gulity plea as images were on his phone. But the police are saying that they still need to check his computers, but it seems wrong that he has already been sentenced. I will also get my OH to speak to unlock. Thank you
