So hubby is going to crown this time next week for 2 counts of communication, mind is going into overdrive. I know all cases are different. Just want to ask how many have had a suspended sentence instead of a custodial for a communication offence

One count (communication with decoy over 2 weeks), and custodial

the judge followed the guidelines

We aren't together but the court experience was unforgettable. Look after yourself

Probation and the Police have recommended a suspended sentence

We have letters from Lucy Faithfull , myself and he has done an accountability letter too

Hubby self-reported and then got the Knock. He is worried sick. I know he is a good man who has done something that he should not have done

I have seen some gone for suspended for decoys, but again it is dependent on the judge on the day.

Character reference, evidence of rehabilitation could help.

Best advice is to prepare for the worst, hope for the best ...

And tbh I don't see why the PSR are done, as said above they pretty much recommend suspended and work through probation in the community every time. It wasn't referenced by the judge in their ruling in my partner's case

please let me know how you get on if you can. My hubby is due to be sentenced for communication 1st September.



If it helps I've been keeping an eye on the news and there are lots of reports of suspended for similar charges recently. Including a police officer who had communication with a real child.



im not giving up hope.

Nemesis I see that OH got a custodial - can I ask for how long ? and is it true that only half the sentence is served ?

It's so hard not to worry about what the outcome will be and I certainly don't want to give you false hope, but because he self disclosed it will work in his favour. Recognising that he's done something wrong and facing it head on.

It is true that for determinate sentences (indeterminate sentences are extremely rare and only applicable for sentences over 10 years) only half the sentence is served. My person was given 40 months but will serve 20 in custody and 20 on license.

My partner was sentenced in April for communication with a decoy over a month, and we had three incitement charges within that too and of the most severe.
18 month suspended sentence across two years, and we were told on the day by his barrister to expect custodial.
Prepare for the worst but you're allowed to have hope too. He's done a lot of work and some judges do give that credit (in our case the judge commented how he could have done nothing more than what he has been doing since the day of the arrest).

From what I have seen, I think a lot of it depends on the judge on the day, the references, the willingness to rehabilitate, the PSR, the suitability for probation, support in court, and how badly it would also affect those around them if he was to go to prison.

How true these all are I don't know. Because I have seen some judges ignore certain things and others really take everything into account. Luckily in my case, the judge did take these things into consideration.

Can I ask - how many partners are 1st time offenders ?

I have decided that if he goes in - I am going to take time out from this wonderful forum just to step back a bit. Everyone here has been so supportive thank you

18 months suspended for 2 years and 10 years on the SOR

SHPO - one prohobition

must notify them of any new email/ social media or gaming account
