was wondering if someone could tell me what it means if the courts have refused bail due to the police not doing their job properly.

Hey there,

Has your person been on bail already? The courts can refuse to extend if they don't think the police have a fair enough application to keep a person on bail. The person would be released under investigation.

Who has told you that it's been refused because of the police not doing their job?

If your person has been refused bail and remanded into custody then it might be because they have enough evidence to charge aswell as other reasons like risk to self or public etc..

Does your person have a solicitor?

Hi thank you so much for you reply the courts have refused bail and when he phone his solicitor they told him it's because they are not doing their job properly with it being a bank holiday and no one to get hold I'm just stressing a bit don't really understand it all
Yes he has been on bail since last October

no not in custody at the moment anyway

I was told by the OIC that bail can only be set for 30 days. If it needs to be extended, it has to go to a more senior person each time for the decision to be made, and there has to be good reason each time to extend it. Apparently this is to avoid people being on bail indefinitely.

From experience it sounds like the Police have put in for another extension, which is very possible as they can apply to the courts in 3 and 6 month blocks.

It sounds like the police want to extend until November time (tried to do some quick maths on the 28 day and then 3 and 6 month blocks from Oct).

If the police didn't apply in time for the courts to approve over the Bank Hol then this could be where the solicitor has their opinion from. As Lee says, it sounds very much like an opinion. I would ring the solicitor back first thing Tuesdsy and in the meantime ask your person to stick to bail and don't do anything silly against their usual conditions.

In my experience the police send their new bail surrender paperwork before the courts have even approved their application and the court letters follow a good while after so solicitor involvement is key!!

It sounds like your person is RUI though if the court has refused the extension... but make sure you check! Xx

Thank you so much for your reply's I really do appreciate it my head is spinning I thought here we go they are going to come back out and arrest him. (I don't now if I'm doing the right thing but have managed to keep it from the kids this whole time so did have a panic ) I think I should have explaind myself a little better we had the nock last October they have been bailing him for 3 months at a time but this time is was refused by the courts. So tomorrow I will make sure he contacts police and solicitor to see what is going on and what we need to do next I have made sure bail is being stuck to just incase.

His bail was up on the 30th of July
