Just received an email from oic and images have been found on my husbands phone (which we knew as they had been downloaded without him knowing). The cps have agreed to go for a charge and it's likely just to stay at a magistrates court as levels of images are low.
im now sitting here worrying again. What can I expect? Because it's staying in magistrates does that mean it's not going to be serious punishment? I just need answers.

I think in magestrites they can only be sentenced a number of years like 1 year, I'm not sure. Also a few have said on here the punishment is picked by a group of people who arnt lawyers or judges, who've had very little training, or could go well for hom.who knows? It's all so scarey and unpredictable x

The oic said he expects it to stay in magistrates as the images are all low level. So is this likely to be no prison and community services sort of deal? We did get told yet again there's a back log so may be a wait, we've already waited over a year x

My partner got sentenced in Magistrates. Very surprised as there was Cat A Iioc but a low number.
It all depends on the panel on the day. If they feel that the punishment is within their sentencing guidelines ie under 1 year sentence, they can agree to keep sentencing in Magistrates, they will agree a date with him for approx 4 weeks time, which will give enough time to get the PSR done with probation.
However, if the panel/judge on the day of sentencing isn't comfortable sentencing or wishes to send him to Crown, they can still decide to do this.
Magistrates sentencing can still be custodial up to 1 year, suspended or community order.

Thank you. I'm unsure how many are there just been told they're all low level so assuming cat c. Is now the best time to make contact with a solicitor or should I wait for the charges to come through? Oic did say there's yet another back log so to expect a delay (like our life hasn't been put on hold long enough as it is) he never had a solicitor for first in interview but we have one lined up ready to take on the case x
It can't help to drop them an email or call just to say iioc have been found and are waiting charges. Once the charges were received we went into see the solicitor, although it ended up being a different one from their company who represented him in court x
