parts of this are so similar to my story.
first of all, if they want to do a risk assessment check what qualifications the sw has and what framework/protocol they will be following. Push for an independent risk assessment if possible, ask if you can fund it/partially fund it/expect them to fund it.
we had a PPR done by our sw which was horrendous and full of inaccuraties/lies and then we had to fight for an independent. Also record any assessment meetings with the sw, tell them you are doing this. You are allowed to record them so they can't say no. Wish we had done this as then we could prove the shit they have made up.
they can seek legal advice, doesn't mean they will be able to escalate your plan. If they do escalate you go to PLO (pre-proceedings) where you then get legal aid and all the solicitors paid for. We are here, it is not as bad as ss made it seem. Actually it's working in our favour as they are now being shown to be incompetent, they are having to fund an independent risk assessment and our solicitors are giving us reassuring advice.
it is so unfair to be in this situation, feeling like you are never making the right decision for anyone and constantly feeling judged. When all you want is the best for your child.
I would say if the stance your ss is taking is seeking legal advice if you move him back, be careful. They are dicks and could say this is crossing 'the threshold' of putting your child at significant risk. Make it clear you will always put your child's safety first, there are no legal restrictions and you will get an independent risk assessment. Put it all in writing, email it to them. Then record any meetings and email them a record of the chat
