SHPO and SOR
Notifications OFF
So husband was sentenced to just over two years he is due home next year.
We were always told that we could eventually get rid of SHPO ans SOR however I'm confused because I think I read that if SOR or SHPO is indefinitely which his was due to sentence (ridiculous considering first offence previous exemplary behaviour and behaviour due to mental breakdown one conversation no photos). So if it's indefinitely apparently you can't ever get rid of SOR is SHPO is indefinitely I can't remember if his or isn't or if sor just was.
Maybe I got it wrong but I'm so upset as basically for one massive mistake they pay for it the rest of their lives no matter what they do?
TIA xx

It's definitely not worth thinking too far into the future. Especially for things that cannot be dealt with right now.
SHPO can be challenged in court at any time. Within 5 year police agreement is needed, after that it's not needed.
Indefinite SOR can be challenged after 15 years by asking the police. No court requirement.
You cannot ask for the indefinite SOR to be stopped while there is still an indefinite SHPO in place, so you have to get that squashed by the court first.
Found this from an earlier thread. I hope this helps xxx

This article might help.

My person has indefinate so we too are keen to understand how he can get it removed. Unfortunately because of his age, it's unlikely to help with his employment but may make his retirement more relaxed. We plan to keep our heads down, comply and then appeal after 5 years.
I too feel the same anger that it was one offence and doesn't seem proportionate. It's the same terms as someone that's physically abused a child - How can that be right?!

It does seems as though contact offences and Internet offences are conflated in these cases, with child protection being used as the reason, despite there being evidence that this is inappropriate and disproportionate in the vast majority of cases. I don't know what has to happen for this to be addressed, I think anyone that tries might be accused of minimising the severity of the offence, or worse, "enabling" offenders.
Anyone who is looking to get SHPO amended when you talk to a solicitor ask them to look at whether it is Smith Compliant. That's the guidelines that are supposed to be followed, however often something isn't. You can search for it on the CPS website.
I read a stat from one police force around those on indefinite SOR who asked to be removed - it was around 50%. Remember that it'll be 15 years before you can ask for that, VISOR will have a pretty good sense of who the offender is after that time.

Sorry to jump on post but my oh had his draft copy yesterday it's got 13 points on it mainly all phone related but there's two more contact ones one is no living with under 16 without SS say so which we have two young children and the other is no unsupervised contact with under 16 unless parents know and get ss to say it's ok is this normal why would say my parents need to have SS involved with them if they will always be there when we visit if anybody could help that would be great
I think you can challenge it and also ask for your own children to be excluded from the provision.
Thankyou his going to speak to solicitor today but it seems like online and off restrictions for something that surely should just be online based
