My oh had his shpo draft yesterday he wants to make it look like his willing to do anything which he is anyway but there's no charges for communication or anything so we thought it would be online only. He has 13 points 10 all relating to his phone and internet one about travel outside of UK one about no living with anybody under 16 unless SS give written consent and the other no unsupervised with under 16 unless can't be helped on daily things like days out and part two of that no unsupervised where the parents are aware of the situation but have got to be given written consent by ss I just wondered if anybody thinks this sounds right or similar to the person's one. We don't want it to look like his trying to get out of stuff but we also don't want stuff on there that's going to make life more difficult than it already is. He will hopefully be speaking to his solicitor after working but I'm currently sat going mad panicking about it all.

I'm sorry, I don't know but hopefully his solicitor can help, it does seem unfair and I know that it is easier to get it amended while it is still draft than afterwards so don't let him just accept it.

The SHPO is meant to be a reflection of the offending. Unfortunately I didn't know about this forum until after my partner was sentenced. He also has the no contact condition despite being online only offender. I have seen others have contested and may have it removed. We did query it on the day of sentencing but the judge said it was too late and would need to request an appeal another time.



So if possible I would get the solicitor to request it be removed before sentencing. That condition is making our lives so difficult.

Thankyou both for the reply.

He spoke to them this evening but apparently they said it's normal for it to be on there and that it shouldn't effect him because he wouldn't have any unsupervised contact with under 16s I'm still confused how that would work with our children though

His barrister/solicitor can fight and change this.

my OH had contact restrictions on there, our barrister said it was not proportionate to the offence and the judge removed them-so he got online restrictions only.



make sure you push that it needs to be changed, if you look back in the forum there are posts about precedents that have been set out in court, why the restrictions need to be proportionate to the crime, shouldn't impact their normal daily life.
It should and can be argued for online only, there have been others on here who have also questioned it and whose barristers fought for it to be changed.
our barrister questioned it before sentencing, once the cps had sent the draft. Then on the day of sentencing we were shown the final version before the hearing and it was online offences only.



also ss were wanting those restrictions on ours (they have absolutely no say in it) because if those restrictions are in place it can be a much harder fight to get your oh home and with your family. without them they have no legal powers to keep them away.

That was on our draft and solicitor said immediately no, that shouldn't be on as

1. we have children so it should not be worded 'no contact with ANY children'

2. wasn't a contact offence therefore not proportionate to the crime

make sure your solicitor asks for it to be taken off. This is likely to last for years and you want to keep things as simple as possible x

I did not know about the SHPo conditions until after sentencing. My OH was not shown a draft copy beofre sentencing. It was three weeks from arrest to sentence and he and his solicitor got covid, so only saw him for 10 mins before court. He has got not contact with u18s. We do not have small children but it will be a nightmare dor him to get a job. But the offence was online only. Unfortunately my OH has his head in the sand so i am not confident that he will sort it. It just seems so unfair that the legal solictors etc do not do their job. We pay for their expertise but seems i have found out more from this forum than from them.

Thankyou so much for all of your replies.

I have double checked and it says no unsupervised contact with under 16s without SS written consent apart from where it can't be helped so guessing days out.

And no living with anybody under 16 without SS written consent

Our children are both toddlers so is this going to be a no go getting him home if it's on there.

He is going to ring again this morning and try speak to someone else because he got passed to the woman that sends all the stuff over yesterday and I spoke to her she seemed an arse to put it politely
