Getting charges dropped
Notifications OFF
The Solicitor for my person has said they are going to try to get the incitement charge dropped as the evidence is not solid.
Has anyone been successful with this happening?- this was an online chat with a decoy on one occasion,no images, no arrangement to meet or distribution.

Hey Seaside,
There have been some cases where certain charges have been dropped or amount of images have been lowered following it being questioned. You can never say never as what is applicable to your case will be unique as no two cases are the same. If our case goes ahead to trial we will be requesting a "no case to answer" which is basically asking (all) charges to be dropped but at the latest possible stage, we would've asked for the charges to be dropped at the start but didn't know it had to be done prior to entering a plea. If your solicitor has suggested this it is a good sign. Fingers crossed this can happen x

Thanks Baffled fingers crossed that this will happen.
We had a plea hearing at Magistrates last week via zoom and the Solicitor advised him to not put in any plea because she is contesting the evidence.

My person didn't get his charge dropped but it was changed to a charge with lower sentencing guidelines. His was "facilitate the commission of" to "incite". His barrister had pushed for lower charges than this but the CPS were not in agreement. My person had a Goodyear hearing where he was given the choice to plead guilty to the lesser charge or go to trial on the orginal charge.
In my person's case, he didn't deny the conversation, just any intent behind it, so the situation sounds different to yours.
