Bail extended AGAIN!

My partner got arrested April 2021.

Bail has been extended a few times and today has been extended yet again until July 2023.

Is this it? Is this my life now? Can they just keep extending and extending? Or what?

Our lives are on hold, I can't take anymore of this fear for much longer it's gut wrenching!

I didn't think they were allowed to extend beyond a certain point and after so many times? Usually they would just release under investigation after a certain point which to be honest is just another form of limbo with less restrictions. What on earth are they playing at?! Has there only been one interview so far? If you don't mind disclosing, is it communication or images? (Please don't feel obliged to answer just wondering what they would be looking at for all this time) x

I'm not really sure what's going on! It's driving me absolutely crazy!

yes, only one interview and that was on the day of his arrest! Only got one item back from them which is my PC as I use that for work so they looked at that quickly but I'm not sure if they have looked at the other items as they are in a "queue"

our solicitor who we've paid crazy money for hasn't even replied to my last email which was a month ago or gotten in contact about this extension I feel so helpless!!

it's images which he says he did not look at in an app called kik xx

That is very odd. Normally, they would do forensics and if anything is found they will invite you for a second interview so either the backlog is huge or they are struggling to find anything, KIK can be very difficult to extract information from, especially if the app was deleted prior to forensics. I would send a follow-up email worded strongly to the solicitor - if you signed a contract/terms and conditions check what it says in regards to level of service expected and also have a look on the SRA (Solicitors Regulation Authority) website at the guidelines for practice just in case you need to remind them of what is expected of their service. Particularly when paying out of your own pocket you should be responded to in a timely manner and I would be rather demanding with them to give you answers. I had a similar problem with our solicitors (although on legal aid) and let things slide to the point I had to submit a formal complaint and threaten Legal Ombudsman action - it certainly shifted the level of service! Xx

BaffledB, sorry to jump in here.... in relation to what you said about the Kik app... is it impossible for the police to find stuff if the app has been deleted. My ex used Kik and he probably deleted it and then wiped his phone. I'm hoping what he did will be found! The police said he distributed iioc on Kik so does that mean it would be saved to his phone and would be still there when the app was deleted? Sorry for all the questions!

No worries! I would say that if he sent iioc then he would have those images on his actual phone (even if deleted) so it will be highly likely they will be recovered. In regards to distribution it may be difficult to find evidence of the chat but if he has disclosed other clues within the chat then it can all be linked to him and should he go not guilty then the fact the same images are in his phone would make it look condemning to a jury. The Kik app is different to other apps I believe due to the way data is stored so what is done in the app remains in the app whereas other apps put data within your phone if that makes sense x

BaffledB... also just remembered that he said his kik account had been blocked.... does that mean that he would have been unable to delete it so the police will find it?

Hi BaffledB,

yes, he was on the app for about a month until he realised the severity of what was on there and deleted it! I just hope they can see he actually didn't click on photos/videos

we emailed our solicitor today to chase up electronics just shocking we have to do that understandable it's around Christmas but we've had no contact for months! we'll see what they come back with but if it continues to not be up to standard I'm definitely going to pipe up! Xx

From what I know of the Kik app - and this may be outdated but you can't just forward pictures as in pressing on them and forwarding them, you would need to save them in your phone and then forward them on so I would say the pics would be in his phone. In regards to being blocked, he was probably flagged due to the nature of the images and his account banned, he would still have been able to delete the app but this leads me to think that it may have been the app itself who informed the Police and could've handed the evidence to them.

Ah well that makes a bit more sense then as to not having heard from the Police. From what I recall of the forensics report in my partner's case they can see how many times images have been accessed. I hope the solicitors come back to you and you hear back soon from the Police xx
