Hello wise ones.
I'm wondering if anyone can help me - I don't know very much about SHPO's, and am wondering if they start at sentencing or after a custodial sentence is completed? My person was sentenced for iioc, no contact or communication offence. I have asked for details of his SHPO from our solicitor - if there is a clause about contact with under 18s, should I challenge this due to the non contact status? If so, should I challenge now or when my person is released?
i ask because we have a young child and I want to ensure as little impact on him as possible.
Thanks in advance. Hope everyone is okay.

Hi,
I don't know about the start date of the SHPO when a custodial is given. I don't think it can be challenged after sentencing until 5 years have passed. If there is a no contact clause it's usually worded like unless approved by ss and probation so it is wise to check before taking your child to visit him if you are planning to. Hopefully his solicitor checked that the SHPO was relevant to the offence prior to court and challenged anything that wasn't but it's not always guaranteed I'm afraid. I hope you get the knowledge you're after xxx

I think it starts when they are convicted (pleaded guilty or found guilty). The Unlock website has a calculator for working out when convictions are spent. It's difficult to get a SHPO amended unless circumstances have changed.
My person has an SHPO, I don't know about when it starts for those who get custodial as he got suspended however I know he doesn't have any restrictions regarding contact with any one in the SHPO only internet/device based restrictions. The PPO/Visor seems to have other ideas. It's really really tricky because on paper it says one thing then gets told different by PO then Visor says different again! I know they are making a risk assessment but based on what??
I think it's really hard to plan for things they are out of our control all we can do is navigate the challenges as they face us.

SHPO starts from date of sentencing, same as the official time on the SOR. (Your partner might sign on before sentencing but after plea, but the length of time they will be on it as determined from that sentencing date).
You can definitely challenge the restrictions, as. SHPO is not supposed to have blanket restrictions but still allow for daily life (whilst safeguarding others and preventing reoffending).
My partner and I have a young daughter (nearly 2) and he was arrested whilst I was still pregnant. Initial SHPO draft stated no contact with under 18s which would have made it impossible for him to come home, and we challenged and it was removed.
It's definitely easier to challenge a SHPO before it's issued so raise any questions or problems as soon as you can. It's not guaranteed they will change but much easier to be heard before a breach is made.

Thank you everyone, your posts have been very helpful and I feel more confident now in knowing what to do when I get the SHPO info from the solicitor.
