Anyone have experience of how extreme/ illegal porn is dealt with or likely outcome? Does it depend if it is found in addition to indecent images or on it's own.... It would come under 'threat to life'.

Thankyou

Hey,

It can vary depending on the nature of it and the CPS. In my case there were a couple of videos which were allegedly categorised as extreme but in my opinion they weren't what I would consider extreme. He was never actually charged for them. The threat to life ones I would imagine will depend on the severity and nature of them. If there is no iioc, and the number of extreme things along with search history etc. is low then I would say the CPS would possibly decide it's not in the public interest to charge.

It's very difficult to know what the outcome will be as there is so much variation around these things. You would have thought with 4 charges around communication that they would've charged for the extreme images in my case but they didn't so I'm not entirely sure whether it was just the police who categorised them as such and the CPS decided they didn't meet the threshold. If it's just extreme images the maximum sentence is 2 years but again, unless there were thousands of images it would be unlikely they would give out that sentence.

It's awful being in limbo and not knowing what is going to come of things. Hang tight until the forensics are finished and it's gone to the CPS, even if they do decide to charge there may be opportunity to question it or mitigate x

They show women dying( presumably acted- I hope). And acts causing injury. Suspicion is of category c images.

I hate this waiting around - it's awful. Just need to try and forget about it I guess.

It really does depend on what it actually is. It's such a weird area of the law and hard to say.

In the UK it's actually illegal to produce p*rn which depicts f*sting, sq***ting and many other things which are widely available online and actually there's nothing wrong with either of those acts so I'm not sure why they are illegal to produce if consensual. Allegedly the restrictions were to protect minors but those kinds of acts are accessible at any time of day to minors if they don't have the correct internet restrictions at home.

I find the same issue with being able to access real extreme material and especially iioc online. The government aren't doing enough to prevent it but they're punishing people who have it. It's all back to front.

Try not to worry too much, you've not done anything wrong, if there are worrying things on the device then it needs to be addressed. These kinds of things tend to get worse if there is an interest there with no intent to address the issue and it's likely it would've been picked up by the service provider eventually if it truly is illegal/iioc.

Extreme pornography is only unlawful if the suspect is in possession of it at the time the devices are seized, it's not something they can charge if found among deleted files.

Due to my recent OCD experiences I've researched all the laws on this.
