Morning all, hope you are all ok. I have a money question. Myself and my husband are going to have to borrow money to pay for a solicitor. We are considering our options. For anyone who has done this are you upfront about the reason you are borrowing the money? Are lenders normally ok with this?

My husband borrowed money as well. He didn't give them the real reason and he was granted the loan. Banks don't care as long as you make your monthly repayments

Thanks for the reply. I want to be honest with them, I am a bit sick of all the lies to be honest. But yes I imagine when you think of the thousands of court cases every year it is probably quite a common reason for people to get loans. And for clarity it is myself and my husband who will be applying, not my son who is the offender.

My OH had put it on a 0% credit card we took out last year; this has bought him a little time to pay off the bulk of it as I think there is a year left on the 0% deal.

So much to think about, my head is swimming. My husband is supportive but leaves all the practicalities to me. He just goes into a downward spiral when he has to deal with the "admin" it doesnt affect me quite as bad so I do it. My son hasnt been charged yet, same as so many we are waiting for electricals to be checked. But the solicitor I have spoken to advises hiring someone to do "pre charge"work. So im in abit of a catch 22 of having to hire someone, take a loan out to pay them with no clear idea of how much I will need because there are many variables

This is when some solicitors come out of the woodwork to mess with people...

It was my husband that comited the offence in my case and our solicitor never mentioned any "pre-charge" work. I'm assuming this is to pay them for chasing the police about the charges or evidence, but If anything, at this stage, most can done mainly by your son.

I'm not sure about what was your son arrested for, but the one thing that it can be done is find counselling for the offence. Do all the work laid here on the pinned threads, chase the police about time frames (they are a joke tbh, but if anything at least they know you guys won't just leave it).

I suggest for him to go full exemplary citizen if possible, get a job if he doesn't have any or get into courses, exercise, heck, even volunteer if time permits. All of that can be used as the show that your son's interest in changing.

As for the loan, I know the lying feels bad, but in this case, the repercutions of this sort of information being out there are massive. You don't need to explain yourself, it's not their business but yours and your family. It's hard, but strongly suggest to say something else, a holiday, home improvements, whatever. It's your money after all, as long as you do the monthly payments, you can use it for whatever. Same as you don't know their business, they don't need to know yours.

My oh took out a 0% interest credit card then paid it back on there instead of a loan

Thanks all, lots to think about. My son is at uni we are in the process of getting counselling,for him, he has completed an online course. So just trying to get all our ducks in a row.

Just a thought if your sons at uni he should be entitled to legal aid x

Hi Jayjay thanks for the reply. I think he might be entitled to legal aid, but I have got the impression from here and other places(ive literally no real life experience) that legal aid does not get you the best representation. The solicitor we have been talking to specialises in this area but does not do any legal aid work. If anyone has any advice on this and would like to share I would be really interested.

My partner got sacked just before sentencing so was going to pay for his solicitor, however ended up being entitled to legal aid. He used the same solicitor whether he had to pay or not. He was brilliant. There are some very good legal aid solicitors, they are still getting paid and remember they work for you regardless. Don't be scared to question them and chase things up. If you don't feel like they are right you can always change. Do some research and go with what you think is right x

Thanks Jay jay. I will do more research, im glad you were happy with yours. ive read such mixed reports of how some solicitors can negatively or positively affect outcomes I just want to get it right.x

Hi I just wanted to ask about people are hiring solicitors vs state appointed solicitor? My person has an Appointed solicitor which I don't believe is charging? Is this right?

My oh changed to a company specialising in this area we paid £300 to change to them but we still got legal aid and they was really good and a very big company they basically stated after we had been quoted over two grand from somewhere else that they all do the same job some are just more greedy and take advantage and it's down to the court that decide they don't care how much you pay for a solicitor if they want to send you down for it they will
