Do I need to declare?

I'm currently applying for various jobs. Because of the nature of my work, these are pretty senior roles. Most of these ask a question along the lines of 'is there anything in your personal or professional life that could bring the reputation of the organisation into disrepute?'. Now for me, the answer is no. I've never had so much as a speeding ticket. Same for my husband (though he has had a speeding ticket!).
However, my brother in law has been arrested and is on police bail for sexual communication with children and possibly arranging to meet (turned out to be vigilantes at which point he was arrested) He appears to admit this, and also turns out he likely has images of children in his phone. He has not as yet been charged or convicted.
Do I need to declare this? What if he is convicted? One potential role is actually working in a prison setting (though in a different part of the country from him), so that brings a whole new set of potential challenges if he gets a custodial sentence! It's so hard navigating all this stuff I never thought I'd have to deal with.

I don't think you would need to declare your brother in law's situation unless they tell you on the application how wide they go on family background checks if at all. I think it's the NCA that do checks on family but even then I'm not sure the family you married in to would be checked or to what level except your spouse or anyone in your household like on an enhanced dbs check. If they don't specify that family background checks are required then I don't think you should declare it as it's not something that would be in your personal life as such. The prison role is more complex as although you are in a different area at the moment there is always the chance that if a custodial is received your brother in law could be placed in your area. I think unlock may be able to answer this if you give them a call on Monday xxx
