Hi everyone,

So the good news first -son had second interview today for job at Hertz and was offered the job.

Visor is happy for him to do the job and doesn't need to disclose to the employer.

They have said that they will do some checks from their HR department at Head Office and I'm assuming that this will include a DBS ?- he wasn't asked to disclose at application or interview stage though.

Would it be best if he now made a disclosure himself so that he can state that the offence took place in 2021 and that it was a one off ?

Hi Seaside,

Fantastic news that visor is happy with your son working without a disclosure. I'm not sure that they can do a dbs check without informing your son that they are going to. It may be worth contacting unlock to ask for their advice on it. I've always been told when employers or potential employers were applying for a dbs xxx

Thanks Lee as always.

He received a letter from the DBS regarding inclusion on the children and adults list due to his previous employment which he ceased immediately after the knock but the nature of the conviction is wrongly stated as this was an online offence and it sounds on the form as if it was a contact offence

I thought a company needed permission to run a DBS check?

Could he asks what checks will be done and if there is any information they need from him? Checks could just be things like identity and eligibility to work and references.

Really glad he got the job and visor is okay with it.

So pleased he has been offered the job its great news x

As for DBS checks before the changes in the data protection laws companies were able to apply for any new starters but now the person (ie your son) applies himself he will get a receipt number that he needs to keep then the DBS form is posted to him directly once he has that he would need to show it to his manager who then signs a letter to say he has seen it, this then is kept on file, no one can keep the original letter because of the new changes but again the company would have to tell him they require a check to be done before his induction period is finished (hope that makes sence) if they dont require it they will then just want the usual checks ie right to work in the uk, NI number, passport, driving licence and referances , but also worth speaking to Unlock xx

Thanks that's very useful information-he has now been asked to provide passport, drivers licence, proof of address and a photo with a start date given for the 11th so I am thinking that they're not going to do a dbs check after all because surely they wouldn't give a start date until that came back would they ?

I would be surprised they do a DBS check for hertz, but I have that someone was fired after a DBs check came back after they started but during the probation (for work) period...tho tbh there were not good at their job and I think it gave the employer good grounds to dismiss them. I think it was more the fact they were asked to disclose and they didn't . This was over a GBH offence

Thanks everyone he's taken all the relevant documents in today and also has a disclosure letter which he will produce if they say that they're definitely going to do a DBS check because he doesn't want to start the job and then be made to leave-this is what Unlock advised him to do.

im just feeling so sad now because I think he won't get the job after disclosing and it's so unfair when he doesn't pose a risk at all but people unfortunately have strong opinions about these offences don't they?

He keeps asking me for advice but I don't want to be the person who gets blamed if it turns out he loses the job as a result-I honestly feel like just getting on a train to anywhere today and leaving all this crap behind.

Thanks everyone for the advice-unfortunately when he took in his documents they said that they would be doing a DBS check at which point he disclosed and was told that company policy didn't allow them to employ people on the SOR because it would cause reputations damage this is despite them saying that they don't discriminate against people with convictions.

I am so sad about this now it just seems like every time we make any progress we get knocked down again

Thanks Another Mum -luckily he was also offered a job working nights at Asda which he has accepted so although it isn't the one he really wanted at least he now has a job to occupy him.

It is very frustrating that there doesn't seem to be any clear guidance given and I'm rather annoyed that the company didn't ask about unspent convictions on the application form or at the initial interview .

He has his nightshift one which I know was not his first preference but it will give him something for now until something else comes his way xx

I'm so sorry. I'm sure we will all understand and feel your frustrations. The SOR carries such and often miss guided beliefs.

I was there was more I could say or advise to give. I think it's been said in the past, but smaller companies I think are less likely to require DBS or ask about convictions.

Thanks all we will get there somehow and I won't give up although I feel pretty battered right now.

There was an article today saying that more men are needed in the Probation service and that people who had been on probation themselves might be well placed to do that role !!- tbh I think anyone could do a better job than the ones we're currently dealing with who don't have a clue

Glad the other job is going forward. It speaks for his character that despite all the obstacles hes got something fairly quickly. Take pride in that, I really wish him and you well.
