Extreme porn charge forensic report and SOR

Hi,
looking for some advice please. The forensic report is back and it's two very grainy pictures and 9 pictures that move presumed to be videos. There are no IIOC but it's adults and animals (ashamed of this). If the images are grainy can they even use them as evidence ? The solicitor has said that he now thinks there is a high chance my husband will now go on the register after advising that this may be able to be avoided and that they are going to pass this to a forensic solicitor to look at. My husband has so far not entered a plea due to no report however he is back in court next week and will have to enter a plea. The solicitor has also said that he may not go on the register but receive a community pay back and fine and that it will be at least another three court appearances as they will want a social work report. Just wondering if anyone had any information or this type of charge. The charge is extreme porn. Thank you xx

Hi,
you've said the charge is extreme porn, but on his charge sheet what is the law act they've used?

Thank you. It's very confusing. There aim is for my husband not to go on the register. At the very start the senior KC advised that it makes life easier not to be on it. It's the same solicitor but he then emailed to say that he will speak with the senior KC and then get back to us. This has happened all along when we go into see them it's the senior KC but before court appearances and such this other solicitor seems to gather information. On the charge sheet it is civic government (Scotland) act 1982 S51A (1) thank you both for your help.
Thank you for your always help and advice Lee. The phone call from solicitor tonight was more confusing than anything. SHPO has never really been explained to us. I think they have perhaps given us false hope xx
I'm not sure on the answer but will follow this post as interested in sentencing outcomes for this type of thing. Supposedly ranging from a fine to prison but how do they decide..... Will be interested to see if your person does get restrictions or SOR. Were they looking for iioc originally?
My ex hasn't been charged as yet but I know there is extreme threat to life porn- videos and images. Does anyone know if children's services get involved at all or only if iioc are found too?

Lee I cannot thank you enough for your help and advice. I wish I could send you flowers or something. Thank you for always helping me and answering all my questions. The solicitor has said that my husband will definitely not face a jail sentence (although how he knows this is beyond me). Thank you all for your help. Today is a new day and things always look better in the morning. Xx
All my fault sorry i'm not sure about children's services as we don't have any children.
Thanks Lee 2.0. I wasn't sure if it would affect unsupervised contact or not that's all. If iioc are found too I presume children's services would potentially get involved with regards to contact?
