Hi,

I have followed you for a while on here (although I rarely post anymore due to my phone not liking the forum!) and would love some advice if possible, please?

My Husband was back for his 2nd interview today and I think we need a specialist computer forensic solicitor. He was shown a picture of our daughter from a few years ago sat on her potty. They asked if he had sent it to anyone else, to which he was advised to say no comment. They also say he has access to a drop box, he says he hasn't, says he hasn't viewed pictures from it but the police say there was a large amount of porn on it. Didn't say illegal, just porn. Now they are going back to investigate this 'drop box' how the hell can we prove he doesn't have access to it?!!

Can I ask who you and your husband used to help with your case, please?

I'm afraid I can't help you with you request but I just wanted to let you know you're not alone.

My husband and I split quite soon after the police had been round so I was never involved in that part but had your husband got a solicitor or barrister, I'm sure he's not the first case like this they have had so do they know if any specialists?

Keep going, you are being so strong and supportive to your husband, this whole situation can't be easy

Hi,

I can’t say who we used as it may identify us, I don’t think the expert works anymore in this field anyway. But I can say that I was pretty frantic when our situation was developing and searched the internet for experts and information. There are lots of companies, the evidence matters company wasn’t one we used but the site did have lots of case studies on there which were comforting. Another guy called Graham Dilloway was very helpful in explaining what he does, what the police look for and how they do it in very much layman’s terms.



I dont know much about drop box I’m afraid but I’m sure they can advise you.

I’m not recommending these people, it’s just my experience.

As far as the police saying there’s porn stored on the computer I’d say ‘so what’. But there is a possibility they will label young, adult images as iioc. My husband looked at adult porn and only accessed legal sites but they still tried to portray the handful of images as illegal. But it’s embarrassing and shaming for them to have to reveal very private viewing in such a public way, even legal porn. The accused is already on the backfoot. Porn might be immoral (not my view) but it’s not illegal.

Sorry.....just to clarify. The computer expert is not the solicitor, they are separate professionals. Usually an independent computer expert is instructed after charge, not at police interview stage but it certainly doesn’t hurt to get some advice now. Even if it’s just to educate you about what actually goes on.

Sorry, I have a question too!!

Do you know if, once the forensic experts are instructed, if they find anything else that might incriminate the client further, they have to report it? My partner is worried as the police found 4 images he had no clue about and worries that if he had no idea about those, another forensic analysis might throw up stuff that gets him in even deeper trouble?

When you instruct experts to act for you, do they only look to challenge specific things the police have said??

Hi,

I’m not an expert either in computers or in the law, just a broken person like most of us. The people I’ve identified will be able to give you this answer.

But my understanding is their duty is to the court. The solicitor and Barrister will draft instructions to the expert with specific questions to ask, usually in response to the prosecutions expert. There may be additional questions the Barrister wants to clarify. It’s my understanding they can put more or an alternative context to the presence of the image (how they may have got there etc) What they can’t report on is the age and category I think (although they may suggest to the Barrister that they may need to be looked at again) The court can instruct both experts to meet and report to the court a joint report on points that are agreed and what’s not. The mere presence of images does not, on its own infer guilt but there is a reverse burden on the defence to offer an explanation of how the images got there.

As I said I’m no expert, only an expert in our own crap journey through this horrible experience.

And don’t forget both experts can and will be cross examined by the opposing legal teams.

Jaded so nice to see you on here. I don’t think they will stop you posting on here. I like the fresh perspective you can offer and think your partner was very strong to face the police in the way he did. You have both survived and giving others hope. That things are no black and white.

Hope life is treating you well. I am still waiting for the police to finish their checking of the equipment....

that’s appreciated. It’s a horrible time when you’re waiting isn’t it?

I just think there are many things we just accept from the authorities. Think for yourselves. I’m sure one day in the future more will come out about the methods used in these cases. It’s my view that the low hanging fruit are just to easy for the police to pursue, I include innocent men in that group.
