Getting items back from the police
Notifications OFF
Hello,
i am after some advice, copied below is an enquiry sent to solicitors. Any tips appreciated.
"My husband is on the Sex Offender's Register and has a Sexual Harm Prevention Order on him following his arrest and a 12 month prison sentence in XXXX.
In XXXX and XXXX we had visits by the police on our house, where they took a lot of electronic items, including 1000s of pounds of my items, including business equipment. My husband was charged again and it currently in prison. In court they declared only 3 computer hard drives had illegal material on them.
I have requested my items back from the police and they claim all have material (not what the court said), nor will they give my items back, without hard drives in them. These are very high-end expensive items, belonging to me and after the previous episode they did give me them back - without hard drives. They have also lost some items - they claim they don't have them but I live in a tiny 2 bedroom house - it's difficult to 'lose items'. I have been refused a list of them items they took, saying they gave my husband a copy (which he does not have). I recently went to the Police Station to meet a Detective Constable about getting items back, the list he showed me (I was not allowed to take away a copy) was vague or inaccurate - some items simply read 'hard drive', whereas others read 'Nikon SLR cameras' - and they are Canon SLR cameras!
I surely feel this is illegal - my husband was charged for 3 hard drives, so surely the rest should be returned with/without hard drives. I am struggling enough as it is without having to replace £1000s of items.
I am seeking advice as to what to do - some of the items have work data on I legally need back, and I may have to re-do the work for free (months’ worth) to rebuild it - which could ruin my business reputation.
I have suffered from severe mental health issues since this and appreciate any advice that can be offered. These are my items and I am surely entitled to them back if no charges for them were brought. One hard drive is family memories and photos and the loss of it feels I'm losing family again.
Do you have any experience in this type of query please?
My husband is unlikely to be coming home when he is released as I cannot risk this occurring again."
