Problems with KC

Hi,

Hope you are all well. Just wondering has anyone changed their KC or had another KC review what has been done? We have spent nearly £9,000 so far and are no further forward. Thank you xx

Hi Lee, hope you are well. We have been going back and forward to court for nearly a year now and a trial was supposed to take place however, it had to be adjourned as the crown suddenly produced evidence that was different to what was disclosed to us and our KC (I think this is a barrister) and the KC felt the judge wouldn't rule fairly so got it adjourned. We are concerned that the KC is now really wanting my husband to plead guilty to just get this over with.

KC stands for king's counsel, previously was QC queen's counsel. It's a high level trial lawyer, and I think can be a barrister or a solicitor.

Sorry, I only know the terminology and not how to help with your situation

we are in Scotland and I'm not sure why but trial for these don't have a jury. When the prosecution presented our KC with the evidence all of it had black over it (sorry not sure how else to describe it) nothing could be seen. The KC did say that he thought this was strange but he told us that he checked with them but when we got to trial they showed the judge the version that disclosed what it all was. It's been confirmed that the images were all deleted and he would need specialised software to get it back which he doesn't have. Now the crown are also saying that they found "sex stories" which is embarrassing however they are about adults. The crown is making a huge deal of the stories and have advised that if he pleads guilty they will drop the thing about the stories and that we don't want social work to know about the Stories as it would be bad for the reports. This is after them saying that he's a risk because he will go into looking at iioc. I'm so sorry for the huge rant here it's just never ending thank you for listening to me.

Thank you Lee that would be amazing! just to add also that I have been to every meeting and have seen what they sent over. The KC advised oh dont Worry about the stories they aren't illegal and then now this. We have another meeting with him on Tuesday. Thank you very much!

Not meaning to hijack this post at all but it's the first time I've seen stories mentioned and I am aware that such stories involving under 18s are a potential concern in my persons case. Any knowledge of this seemingly grey area would be welcomed!

Rachel surely the KC can argue to the judge that the evidence has been brought in at the last moment, is not relevant, and should not be presented in court?

This sounds like a scare tactic to me to get a guilty plea, because the prosecution knows a guilty though trial is at risk. Unfortunately they will want to get a result after all the time and effort they put in

Thank you everyone for all the comments and advice. My husband doesn't have any previous convictions. The KC tried to argue on the day that the report shouldn't be used as the judge has been compromised into giving a fair trial. The judge agreed and said we would have to come back at another date. The KC just gave the impression he had no idea what he was doing. Kept talking to himself. The other thing is that we aren't sure he even turned up to the pre trial diet. The crown had advised that there were no witnesses and then in the day they called some police computer person who then never turned up. You couldn't make it up.

Thank you so much Lee! I'm not sure if it's the same story. I think we just have to continue with the not guilty. The KC is even saying we don't want the people who wrote the pre sentencing reports to know about these stories. It's all so confusing: thank you for your help. Xx
