Appealing court orders

Hello everyone

Just asking if anyone has any thoughts about appealing court orders I.e. being removed from SOR and SHPO and if so at what stage post sentencing and any success stories. I have been thinking about how much work and effort my husband has put in since being sentenced 2 years ago and the effect these orders has had on me and my family. 2 years does not seem a long time but his commitment to ongoing work for the probation service, additional course work (not mandatory or ordered through the court) and voluntary work has been positive and commendable. Before I make any suggestions to him I would welcome any feedback positive or negative from forum members. Thank you all for reading.

Hi Katie, I think it depends on how long he was given on the SOR and SHPO. I know if you have a lifetime then you can, but you have to wait a certain number of years.

My ex has 10 years on SOR and SHPO. He was told by his solicitor he could appeal after 5 years but it wasn't worth appealing before then.

My partner is planning to request a removal of a condition on his shpo.

He got ten years, and was told the same as lee mentioned above. So he waiting until next year at the five year mark so police do not need to be involved.

He was online offence, but was lumped with the no contact with under 16s. This has had the biggest impact. It wasn't made clear why this condition was added. In theory the SHPO should reflect the offence, however I suspect they added it because my partner offended for over ten years.

He has numerous assessments (for family court purposes) stating he is low risk of contact offending, but remains medium risk for online offending. So we hope to argue that the SHPO conditions on montioring his online use and disclosure of devices should suffice.

Tbh I may ask him to look into this sooner, because I have friends who might want kids in he next year or so....time is running out and if I have to disclose to friends then I have to disclose to family too due to inter relationships.

Thank you ladies for your responses. My husband was given 10 years on SOR and SHPO, both with minimal conditions I.e. reporting contact with a minor if staying in the same building for longer than 12 hours, reporting travel if away from home for more than 3 days and allowing search of personal devices on a now annual basis. I have absolutely no faith or trust with the police and believe waiting for the 5 year mark may be more favorable for his appeal, my concern if it then has to go to a judge is will the press become aware of an appeal process and print the whole saga again, I know I will not be able to go through that again after the most horrendous press coverage. I am under no illusion of the seriousness of internet offences but I am still of the opinion 10 years is so disproportionate after receiving a 12 month sentence, tagging and the public kangaroo courts suffered by so many after the vile press coverage. No wonder a lot of people who want to do the right thing find it difficult to move on with their lives. Thank you all again for your valuable input.

Hi Lee

Sadly police do get involve when someone apply for removal of SHPO and SOR even after 15 years post sentence.

We manage to get SHPO removed few years back with no issues but for SOR police refused it and my OH has appealed it in court. Its a long process. I will update the outcome here.

Also about media involved I heard they don't get involved in it.

Thank you so much Lee for clarifying that, I feel more reassured now if and quite likely when we go down the appeal route.

Sparkle thank you so much for sharing that information. I sincerely wish you success in your appeal, would you please let me know how you get on. May I also ask about your circumstances i.e. how long ago was the offence and is it SOR and SHPO you are appealing? If you don't want to share on the forum woukd you be able to private message me?
