Selling Home

We have sold our home recently and we were never asked this question.
I think if you're not asked you don't have to declare

Agree with hpl111, it isn't a question that's asked and I've never read anywhere you have to declare. You do have to declare any neighbour issues and that's the only question of that type I remember
I have recently tried to sell my property and was told once I'd received an offer, that I would need to declare to buyer one of the owners is in prison. Frustrating as I'd been honest from the beginning about our circumstances and was only told this much later. I have since withdrawn my property from the market as it's not something I was comfortable sharing but that's a personal choice. I shall list the property again upon his release x

One of the owners being in prison makes sense, will be harder to get all the legal stuff through and signed I'm guessing?
Blue Sky is be interested to hear what unlock say if you could update!

It wasn't to do with the signing of the paperwork as we'd got that covered with use of a solicitor, apparently there's a law in place which says you have to. Would have just been helpful to know that before I got it ready for sale/viewings and wasted everyone's time x
Crikey. I never thought of that. Might be selling my house. Yet another thing to put in our way. Though my OH is not in prison. I just cannot believe how many obstacles that are put in our way.
We are selling our house and its not something you legally have to declare. My fear though is that if it comes out in the press they will work it out. If they go to prison apparently they can still sign legal docs. Although I imagine its a lot harder. My ex will be sentenced at end of Oct. Praying he doesn't as I don't know how I would handle stress of paperwork, moving etc and keeping my son on an even keel
Hiya hun.
we sold our house 2 weeks before his first court appearance and nothing was said. Nothing mentioned in the paperwork.
Luckly no press in court or paper coverage.
But you shouldn't have any issues.

I don't understand why selling or buying should be a problem.
We currently have our house on the market and hopefully will sell and downsize to get a house with no mortgage. Why should there be any problems ?

https://get-help.stopitnow.org.uk/family-and-friends/family-and-friends-forum/topic/3764#reply27373 this older thread has some interesting info in it, perhaps if you search the topic someone else will have discussed your particular dilemma (I don't have the energy tonight to go through the entire forum!)
I canot see anything online that suggests you'd have to declare pre conviction (and I can't find anything about it post conviction either, it doesn't come up in any case studies- but best to check with a solicitor)

In any house sale or purchase I have made this has never been a question I've ever been asked. The person carries the conviction not the property so it would make sense that any declaration would be about the property not those within it. The two are separate entities. If Unlock don't know of any defined 'law' don't look for problems that aren't there. x

Amazing Blue Sky. I thought that was the case but it's brilliant to have it confirmed
