Hello all

My OH has a work meeting next week and thinks he may lose his job. He has been suspended with pay so far. He's been in touch with ACAS and they just said he would have to plead his case as best he could as the offence is of this nature and the company he works for was mentioned by the vigilantes. Think they'll say it's gross misconduct and bringing name into disrepute :( as he hasn't been charged yet. Still on pre-charge, will anything show on any checks people might do on him. He's obviously going to apply for jobs where minimal checks are needed. Thanks

If he hasn't been charged, then he is innocent until proven guilty. So the suspension should continue until the police investigation is concluded. If he has complied with all the terms of his employment contract then he should not be dismissed. Is he a member of a trade union?

Different companies have different terms and conditions. Some require the person to notify them once they are charged for example and some do not. The larger the firm, the more likely they are to comply with all the rules and regulations of employment law. Smaller businesses will hire and fire people with no due process, while bigger ones won't, because they are frightened of being taken to a tribunal for wrongful dismissal.

There was a case in the news recently of a teacher who has been suspended for 18 months, under investigation for iioc.

My husband also lost his job he was arrested at work they suspended him at first with full pay for 5 months. Then he was forced to resign or they would sack him, he was with a union who fought for him to get a pay out. It all had to go through a work solicitor who checked everything and it was the right decision to resign otherwise he'd get nothing.

He now has a new job he retrained and straight away a got a new job and they didn't do any checks. The job is much better mentally for him it's not stressful and we get more family time.

Thanks everyone for your feedback. It's hard to know whether to go before pushed. Its all really unfair.

It is really unfair I was so annoyed that the police arrested him at work there was no need at all there was no risk to anyone.

id wait and see what his employers say first as most will most likely want you to resign rather than sack you, if he is with a union get advise. Also if he has been there a long time he may be able to get a pay out, my husband's employer knew exactly how much he was entitled to. Whilst we thought they were being nice they were actually getting legal advice.

My fiancé lost his job the day after he was arrested and RUI. He was signed off sick for at least 2 weeks but they fired him anyway.

He was out of work for 2 or 3 months and now has an agency job in a warehouse.

He was supposed to report to the police station for bail yesterday, so booked a day off work, but the OIC called and emailed him to say they haven't managed to gain access to his phone yet, so he didn't need to go, they would just be extending his bail and will let him know his new date.
