Folks I need your advice please x

So OH was dismissed as of Mon. Cited gross misconduct. Someone saw vigilante video on social media and reported it so he was expecting to be dismissed. Now he's looking for other work but is unsure of how to go about things.
If he gets asked about previous employment he'll have to say he was dismissed for gross misconduct . Then who does he get a reference from. He's in his early 60's so age is a little bit against him.
He hasn't been charged yet. Just really struggling to help him with which direction to go in. He's trawling the job sites and I don't want him to be disheartened.
He won't get any help either as he has savings.

Firstly, can he be sacked for misconduct when he has not been convicted of anything? What is their basis for the sacking?

I thought about unlock too. it's just knowing where to get help in this limbo period of waiting for things to happen whilst not knowing what's going to happen.
He can get quite negative even before all this happened so just looking for positive suggestions to pass on x

I googled what to do if sacked. Google suggested doing temp jobs as usually there is less background checks done. This would give a newer reference.
I am so sorry this is yet another hurdle. My OH was suspended then sacked on conviction so that is what i thought happened in every case.

Hi,
In terms of employment post sentencing there are companies on ban the box. Asda, Boots and a few others that I can't remember don't ask at all but there are some companies who ask for unspent convictions at some point in the process but say it won't impact their decision. It does with this and makes me question if they should be on the scheme at all but that's probably a topic for another day xxx

There does seem to be a bit of help out there for people who have/had convictions but this interim period is such a grey area. What to disclose. If anything at all if a person isn't charged yet but will be at some point. So frustrating. Thanks everyone who has replied though. It's much appreciated xx
Does he have a work union? If so he should speak to them. My husband was arrested at work and then suspended, after 6 months they forced him to resign but they had to pay him off as he hadn't been charged yet and after all your innocent till proven guilty.
No unfortunately he wasn't in the union at the time. He had been but had cancelled it ( being tight ) then when he enquired about rejoining and getting help they said they wouldn't be able to as the investigation at work had already started. Very unfortunate :(
That's a shame but I still think it's worth getting some advise they can't just sack him, especially if no charges he is technically still innocent. They should give him the option to resign.
Thanks for the advice. I'll speak to him later. I think he has 7 days to appeal the decision. One of the reasons they gave was because although he apologised for his actions he didn't show any remorse for his victims. They knew the 'victims' were a vigilante group. I know they could have been children and I know without doubt he would have been remorseful if that was the case. How could he show remorse towards a group of adults who went onto an adult site pretending to be children.
