Hi all,

Does anyone know when forensic evidence is presented? Is it presented to the solicitor via the CPS before a plea hearing??


Could charges be withdrawn due to lack of forensic evidence?

You should get a report from the CPS, it's available to the solicitor up to 5 days before plea hearing. Be aware though, it's not usually 5 days before, ours was late Monday and he was in court 10am Weds, giving me 24hrs to go through 100 plus pages, while trying to work!!

I have heard that legal aid solicitors leave it to share with you the morning of the court case though so I would chase if you haven't heard. We had a private solicitor, everything was talked through before so we could go in court at 10am and say we were ready. We were first in and there was loads of legal aid solicitors sitting in there going through their cases (basically reading it all before going to speak to their clients) but they take no notice of your case, they have their head in their own.

CPS report will have charges, statements from officers, transcripts of interviews, evidence which will have all the forensic evidence. Some of it is hard to read so you have to spend some time getting your head around it and some of it I couldn't understand what it had to do with the charges. I think it was back up to their evidence.

We have a private solicitor as we're over the threshold for legal aid but I don't think you'd get the same attention with a legal aid solicitor and with these cases we need the best possible representation don't we .

I've seen some people posting about no evidence found on devices but still receiving charges, ihow can they link evidence to a person if nothng is found on their devices xx

Sorry. Betty, re read what I wrote and sounds like I was presuming you had a legal aid solicitor, wasn't my intention, was just trying to get you to chase if you was in that position. I think a lot of people are let down by this.



I suppose the only way that would happen is if you admitted guilt at arrest and they had it on body cam? Or spoke in your 1st interview and don't no comment? I am actually not sure, I watch a lot of solicitors on Tik tok and they say a lot of people get themselves in triuble as they just talk, when there is no evidence.
