Maximum bail amount

Hi



Does anyone know what the maximum bail is allowed?



I know it's 28 days then apply for 3 months/ 6 months etc but we're now at about 15 months bail and I thought there was a limit before they have to charge or RUI?



Also, am I right in thinking RUI is without conditions? Would that mean they could come home or would they still stop that?

Hi EA - it puzzles me when the police keep to such lengthy time periods for bail (assuming it's pre-charge?) as other people have said that on here too. Your description of what the time frame should be is certainly what our son experienced before being RUI and it's what you find in official guidelines.
Before this his defence barrister had approached the police asking for the conditions to be dropped as for an online offence they were disproportionate being to do with contacting children. I think the police have a 'one size fits all' approach and usually get away with it as at arrest there is usually compliance with everyone thinking it will speed things up (HA HA) The police refused to change his conditions so the solicitor wanted to take it to magistrates court but as that would cost a further £2000 our son decided to stick with his conditions as they were until the next bail extension when he was RUI, exactly what the official documents state should happen (we will never know for sure if that was because of the police realising he had a solicitor so played it by the book but we do wonder.....)

We are no better off really as his children are subject of a CP plan (because of both our son's offence and some serious risk from his ex now he's unable to protect them) so he is still under conditions although not legally enforceable now. We get on well with the children's SW so we are accepting the conditions for now and feel like it's more our choice rather than something enforced upon us.

I hope someone will pop on here who knows the legal background for extending bail past the official 'in house' time limit if they haven't gone through the court to get it signed off.... there must be valid reasons otherwise they are just pushing their luck as it makes life easier for them to just extend or else they're not doing their job very well.

I am very interested in hearing from other people how this all might work, what I've missed in the 'regulations' but you might like to consider challenging the bail if any conditions are about contact and the alleged offences were online only. Otherwise if there are no conditions then perhaps bail is a better option as RUI can take forever as the police don't have to justify a time frame as they would with bail......and so we wait and wait!!!!!

I heard is was at 9months they have to go in front of a judge to justify why still on bail.

We went to RUI at 6 months with a safety plan in place for the children and still on CIN so there is no unsupervised contact with him while he is back living in the house.

That took a lot of work between me writing the plan and getting the police and SW to agree to this approach together.

To get past a certain point they apply to court which ours did and its awaiting approval but in that approval time it continues.. we're near the end of that time and it's not even been approved by the court which I find crazy.



So your person is living at home? How do you work around the no contact with them there? Ours needs bail conditions because if I'm asleep I can't supervise.



I think our SW would work with us on this but the police won't budge even thought they're not offering solid evidence as to why

I wish to get a better insight on this too, my OH's bail has been on bail a year, tried appealing and got nowhere, we're trying again as living seperately is financially crippling us and because we don't know what's going to happen we can't DO anything that would help us with finances.

what's worse is my child has been put on a CPP since before they were even born and according to my SW this won't change until the police decide what they're going to do as he hasn't been charged yet. Been going on a year and he's heard from his solicitor that they want to extend it for another 6 months! bloody ridiculous.

My oh was on bail for 17.5 months I don't think there's a limit

I've just counted rather than guessed and it's been almost 18 months for us. Everything I've read seems to point to 18 months bail being the max until rui so we'll soon see. I'll update when I ever here from them
