Hi everyone,

Hope all's well with each of you.

My person is at a plea hearing in a few weeks and we were talking about remand and bail.

If he got remanded until the next hearing would it be looked on a bit more sympathetically at sentencing if given a custodial? Ifyou know what I mean... Innocent until proven guilty but still being held on remand.

We're hoping bail but on this journey you never know xxx

Time spent on remand should be deducted from any custodial sentence, if that happens. Time spent on bail won't be deducted.

Hi Edel, if it was say 4 months on remand it would be just the 4 months of a custodial?

As you're not actually sentenced would remand time be looked on more leniently when passing any sentence?

Do you mean if being on remand would be looked at us a mitigating circumstance and the sentence would be more lenient because of it?

That's not the case, remand is not a reason for a shorter sentence. However, if your partner was on remand for eg 4 months and then was handed a 12 month sentence, they would take his remand as having already served 4 months out of the 12 months needed.

Is there a particular reason to believe he will be placed on remand after plea hearing if he's been bailed so far?
