Who is kept informed of when it goes to court

Early days but contact is fizzingly out with my person and he had moved several hours away now, I had to give a witness statement at the start as I am the one who found the images on a memory stick.... I'm wondering if I will have to give evidence or my statement just read out?

If I am no longer in contact with said person and they haven't given full disclosure (hasn't done anything proactive just head in the sand) will I be informed when he goes to court (Which could be local or where he is based now unknown)

Im not sure what the future holds but I do know it would be hugely important to me to have answers and some sort of closure on what they find. I saw a few images out of the hundreds - but then he is telling people it's nothing hardcore - in some ways I wish I had scrolled through more so at least I would have some answers but again what I saw was enough to haunt me.

Scared to loose contact and loose my chance for closure, but then again possible years of constantly reminder of all this mess.

I wasn't told anything - husband gave me his version but the solicitor just told me the sentence. I had to contact the court system to find out the truth.

I am in a similar position. No contact with ex but i need closure so want to know charges, sentence etc.

I have called the OIC every so often and he has been very helpful. He told me there had been a second interview and that everything would be sent shortly to the CPS. He wouldn't tell me about what was found.

If you register on Courtserve you can keep an eye on who is in the mags / crown court everyday. I look daily and intend to go so I can hear charges

As a witness you should be notified when it goes to court by the Crown Office and Procurator Fiscal Service. You can contact them directly to check they have your contact details. They are able to tell you the charge but can not disclose evidence .

Hi Bondi - do you know whether he is pleading guilty or not guilty as that would make a difference. If not guilty then your testimony will be important to the Crown Prosecution Service and you would be called as a witness and questioned on what you said in your statement. You should have a witness care officer who will give you all the information about trial dates etc. If it's a guilty plea then you may not be told anything at all unless your person gives permission for you to have full disclosure. I know quite a few ladies on this forum feel really frustrated about this when they want to put a full stop to things but can't. I'm not a legal expert but I volunteer at my local law courts so do message me if you'd like any more innfo about being a witness if you know what he intends to plead.

If he pleads guilty then you will most likely not find out anything without full disclosure. My guess would be that the hearing will take place near to where the knock happened, no matter where he has moved to now. Basically, if it doesn't make the papers at all then you probably won't know anything about it. If he pleads not guilty though, you will be sent a letter to tell you where and when the trial is expected to take place.

Thank you for the replies.

I supplied an initial witness statement but not sure whether I will be called up as a witness as they can only ask me where I found the usb with the images. I don't have a witness person/link but maybe once they go to court and they decide if they need me I will be informed?

I have no idea if he is pleading guilty. I would imagine (hope) so, as he can't deny they were 'his' images he downloaded but I guess it depends what they want to charge with if he agrees to plead guilty.

Ive asked him for full disclosure but got no reply.

Would the officer in charge of his case inform me? Technically half the devices are mine been searched so hopefully I will at least know when that stage is completed.

My OH plead guilty and had a date for going to court but I only found out because I got a letter from the court which told me the date and the charge . They explained they still inform witnesses of the date even if the accused has plead guilty as the accused could change their plea. I was called a witness as I had witnessed his arrest after the Knock .

@bondi you could try calling the National help line for the Crown Procurator Fiscal Office and check they have your contact details . I do have an email but I think that was for the Sheriff and Jury VIA officer who was dealing with the case . Hope this helps

Hi Bondi

I was in the same situation as you, I found my ex-husbands memory stick with iioc on and called the police. I gave a statement and was a witness as I found the memory stick. The OIC kept my updated as did the Witness Unit as well, I knew my ex husband wouldn't give my full disclosure(he lied to the police) so I decided to go to the magistrates court and the Crown court to hear the evidence.

If you ask the OIC to keep you updated they will let you know the date it will go to the magistrates courts and you can seat in the court. It will go to the Crown court depending on how many images and the Categories, the age of the children, how long this has been going on and if your ex is remorseful and I mean genuinely remorseful.

I am glad that I went to court as hearing the evidence confirmed that I had made the right decision in divorcing, it was also a shcok as I had no idea of the numbers or how long this had been going on for. The comments of the judge were also interesting, so if you want some closure I would advise going to court. They don't read out all of the evidence and I tried later to apply to the court to see all of the evidence but was refused, you need the permission of your ex to do this. However if you have an adult child they may be able to access this information.

I shall email the oic for an update and request to be kept updated.

I shall enquire about the witness unit too, his devices haven't been checked yet so not sure what charges he will be presented with.

Thank you for sharing your experience of court, I know I need some closure even if it's just knowing the charges and the outcome for my own piece of mind.

Hi Bondi, I just want to make you aware that it's at the discretion of the professionals in the court room what gets read out. If I hadn't had full disclosure via my husband and the solicitor I would have been none the wiser when I left court as they just mentioned numbers, categories and a single date, and nothing else such as length of time, ages or gender, content of images etc.

I hope you get the closure you want but just be aware that this is a possibility. I would also suggest specialist counselling if you are struggling with it all. Best of luck
